In addition, a written <br /> confirmation of any oral agreement must be submitted before any payments will <br /> be made. The Request for Payment Form (Appendix C) shall be submitted, <br /> includirg all invoices, at the time of payment requests. <br /> REQUESTS nR FUNDING FOR PROMPT ACTION <br /> Regional Water Board's Executive Officers, and LTA Directors (or their <br /> designee), may request up to $200,000 if prompt action is required to protect <br /> human health, safety and the environment and the responsible party, if any, is <br /> either unable or unwilling to comply with a written corrective action order <br /> requiring such prompt action. Approval of these requests will be limited to <br /> those cases where a situation poses a threat to human health, safety or the <br /> environment and prompt action is required. Requests must be submitted in <br /> writing to the DCWP Chief (See Appendix B). All prompt action requests must be <br /> approved by the State Water Board. To be considered, the request must include <br /> information specified in the Funding Criteria section, including a copy of the <br /> corrective action order, a completed EAR Account Request for Funds Form <br /> (Appendix B) and a specific Resolution authorizing the funding request. If the <br /> DCWP Chief determines that the request is eligible for consideration, it will <br /> be presented to the State Water Board with a staff recommendation. <br /> The UST Cleanup Fund Section Chief shall review all prompt action requests and <br /> present them to the State Water Board with a staff recommendation within 60 <br /> calendar days of receipt of the request. <br /> ABANDONED AND RECALCITRANT SITE ANNUAL FUNDING REQUESTS <br /> The State Water Board will be presented an annual statewide priority list, with <br /> staff recommendations, and will establish the annual amounts to be allocated to <br /> approved sites contained on the list. The Regional Water Board will establish <br /> priorities within their respective region for all LIA and Regional Water Board <br /> proposed UST leak sites. The UST Cleanup Fund Section Chief will establish <br /> statewide priorities if funding requests exceed the available resources. The <br /> relative priority for each proposed site will be established to direct limited <br /> resources to the highest priority water quality needs. <br /> ANNUAL SCHEDULE FOR PROCESSING ABANDONED AND RECALCITRANT SITE FUNDING REQUESTS <br /> o October 1st - A request will be sent to all Regional Water Boards and <br /> LIAs which contains information needed for the Regional Water Boards to <br /> recommend and prioritize LIA and Regional Water Board abandoned and <br /> recalcitrant sites within their region for EAR Account funding. LIAS <br /> should contact the appropriate Regional Water Board if they have any high <br /> priority abandoned or recalcitrant UST sites which they want considered <br /> for inclusion an the EAR Account Annual Sites List. All prioritized <br /> Regional Water Board lists, including a Regional Water Board resolution <br /> which adopts their prioritized annual list, must be submitted to the UST <br /> Cleanup Fund Section Chief by March 1 to be considered. <br /> o March I - The UST Cleanup Fund Section will review and develop statewide <br /> priorities based on all Regional Water Board lists received. The <br /> statewide prioritized list, including staff recommendations on which <br /> sites can be funded, will be mailed out to Regional Water Boards and LIAs <br /> prior to the May State Board Workshop. <br /> -7- <br />
