List may be adopted at this time if there <br /> is no significant opposition. <br /> o June - The annual list will be presented to the State Water Board at its <br /> workshop for approval at the State Water Board meeting. <br /> ALLOWABLE COSTS <br /> o Reasonable and necessary costs of corrective action performed by or for <br /> the State Water Board, Regional Water Board, or an LIA; <br /> o Costs for emergency cases shall be limited to those costs necessary to <br /> abate the immediate threat to human health, safety and the environment; <br /> o LIA staff costs directly related to the funded site, based on the number <br /> of hours spent by each employee (name and civil service title) for <br /> oversight of the corrective action and any enforcement action required. <br /> ALLOWABLE ACTIVITIES <br /> o Any actions necessary to stop the unauthorized release of petroleum from <br /> a UST, including removal of the UST and associated piping; <br /> o Any interim remedial actions required to mitigate fire and safety hazards <br /> posed by vapors or free product, minimize the spread of contamination, <br /> and remedy hazards posed by contaminated soils that are excavated and <br /> exposed. Allowable interim remedial actions may include, but are not <br /> limited to: <br /> - Removal of free product; <br /> - Enhanced biodegradation; <br /> - Excavation and disposal of contaminated soils; <br /> - Excavation and treatment of contaminated soils; <br /> - Vacuum extraction of contaminants from soil or ground water; and <br /> - Pumping and treatment of ground water. <br /> o Any activities required to investigate the site and take the required <br /> corrective action to cleanup an unauthorized release from a petroleum <br /> UST. <br /> FUNDING CRITERIA <br /> Each application for EAR Account funds will be judged on its own merits. <br /> Except when funding is requested to initiate immediate emergency corrective <br /> action, or for those sites where no responsible party can be located, requests <br /> for funding will only be considered if the responsible party is either unable <br /> or unwilling to comply with a written Regional Water Board or LIA corrective <br /> action order, pursuant to Section 25299.53(c) of Chapter 6.75. <br /> A Resolution is required at the time of prompt action funding requests or when <br /> submitting the annual prioritized list of abandoned and recalcitrant sites. <br /> The purpose of the resolution is to authorize the Regional Water Board <br /> Executive Officer (in the event they do not already have full delegated <br /> authority) and the LIA authority to: (1) approve LIA funding requests; <br /> -8- <br />
