Mr. Kelly Reilly . - 2 - 25 July 2007
necessary. We request that you and ExxonMobil Corporation, or their environmental
consultant (ETIC), make all attempts to reach a successful conclusion, and we are willing to
meet with you in an effort to reach an agreement. However, since the investigation has
already been delayed due to your actions, the latest due date for the needed additional
investigative activities is nearing. We are prepared to give a reasonable extension of our due
date if a cooperative agreement, between yourself and ExxonMobil Corporation, can be
reached shortly. Nevertheless, if you do not reach an agreement with ExxonMobil Corporation
to allow reasonable access and the conduct of the needed activities, affecting the submission
of the investigation report by that date, you will be required to conduct the necessary
investigation on your property in accordance with California Water Code Section 13267 or
13304.
Please inform me by 10 August 2007 of your intentions to provide access for this
investigation. Should you have any questions regarding the above, please contact me at
(916) 464-4615 or my supervisor Jim Munch at (916) 464-4618, or we can be reached by
e-mail at ibarton(aawaterboards.ca.gov or imunch(cDwaterboards.ca.gov.
aures L.L.
