0 <br /> Ms. Jennifer Sedlacheck - 2 - 22 February 2006 <br /> Mr. Duane and Ms. Wendy Berdt <br /> Ms. Theresa Marler <br /> • plans for interim remedial actions to abate or correct the actual or potential effects of the release <br /> in accordance with Section 2722(b) of Title 23, of the California Code of Regulations (UST <br /> Regulations): <br /> If the investigation does not fully define the vertical and lateral extent of petroleum hydrocarbon <br /> contamination at your site,the Report shall include a new Workplan for an investigation to complete the <br /> characterization of the pollution. The Report shall also include a property parcel map depicting your site, <br /> the extent of your identified hydrocarbon plume, and all parcels located within 500 feet of your site and/or <br /> your defined hydrocarbon plume. For each parcel located within 500 feet of your site and your defined <br /> hydrocarbon plume,you are to provide a table of the parcel number, the name of the owner for each <br /> parcel, and a mailing address for each owner for public participation notices. <br /> All work must be performed according to the Tri-Regional Recommendations for Preliminary <br /> Investigation and Evaluation of Underground Storage Tank Sites and Appendix A. Appendix A is found <br /> under"available documents" on our Internet page at the web address in the letterhead. All paper copies of <br /> the Workplan and Report and all future reports must be submitted to this Regional Board and to SJCEHD. <br /> Concurrently with the paper copies, electronic copies of the data,boring logs and complete documents <br /> (Workplans, Reports) shall be submitted to the State Water Resources Control Board (SWRCB) <br /> GeoTracker Web site. You will also need to obtain any required SJCEHD permits for borings or <br /> monitoring wells, and contact SJCEHD and myself at least three working days prior to any fieldwork. <br /> In addition, Section 13267 of the California Water Code states, in part: <br /> "(b)(1) In conducting an investigation..........., the regional board may require any person who has <br /> discharged, discharges, or is suspected of having discharged or discharging, or who proposes to <br /> discharge waste within its region...shall furnish, under penalty of perjury, technical...reports which <br /> the regional board requires. The burden, including costs, of these reports shall bear a reasonable <br /> relationship to the need for the report and the benefits to be obtained from the reports. In requiring <br /> those reports, the regional board shall provide the person with a written explanation with regard to <br /> the need for the reports, and shall identify the evidence that supports requiring that person to <br /> provide the reports" <br /> Failure to submit the required Workplan by 15 May 2006 and/or the required Report by 15 July 2006 may <br /> result in additional Regional Board enforcement action. <br /> You may callmeat(916)464-4615 for questions or additional information. <br /> )JAMES <br /> io�° Mak-4 <br /> L.
