There are a number of inaccuracies in the <br /> report and we feel they need to be clarified before they become items of record. <br /> The spill referred to in the letter was a small amount of sulfuric acid (farther investigation shows <br /> less that 2 gallons) that was being handled by Simplot personnel in a manner we considered Best <br /> Management Practices. It was never our intent to conceal this work. The personnel that work in <br /> that area are well trained to handle sulfuric acid. The affected soil was intended to be used in our <br /> granulation plant, so we never considered it a'waste. However, we are now handling the <br /> excavation according to instructions from the San Joaquin County Health Department and your <br /> office. Ms Schwab is in contact with Harvey Homer of the Lathrop facility on this issue. <br /> Observations and Comments: <br /> Paragraph 2 — <br /> • The non-hazardous dye was in the water going to a Class II surface impoundment, not the <br /> pond with the ducks on it(stormwater pond). <br /> • The sumps are open to rain water because they are designed to pump rainwater to the ponds. <br /> • The metal pipe is not"severely"rusted. It is metal and is rusted on the outside. It is fully <br /> visible throughout its run and is inspected at least three times a day to insure that it retains its <br /> integrity. <br /> Paragraph 3 — <br /> • The two pipes extending in to the stormwater pond are not "abandoned." What Mr. Batterton <br /> stated is that they are "locked out"to prevent unauthorized use. The dripping liquid was <br /> fresh well water, which Mr. Batterton stated before we left the area. <br /> Paragrah 5 - <br /> • We apologize for the confusion when asked about the lysimeter sampling ports and leachate <br /> collection sump pump location. When Ms Schwab first called, on May 3, 2000, to set up a <br /> meeting she described it as a"get-acquainted tour",just a brief overview of the plant. Had <br />
