Mr. AIexander MacDor
RWQCB
May 8, 2000
we known it was actually an inspection, we would have had the appropriate personnel on the
tour to answer all her questions. Further inspections will be more organized.
Paragraph 6—
• Mr. Batterton fully explained the situation regarding the removal and replacement of the
small sulfuric acid overflow tank.
• It was never our intent to question Ms Schwab's authority regarding the soil under the
sulfuric acid tank slab. When Ms Schwab began to detail what she felt was our appropriate
course of action - elaborate work plans, soil sampling, and excavation, I asked what the
reporting quantity was, or, at what point does a small drip warrant this extensive process? At
that point she stated that we needed to prove to her that there was no environmental harm.
We were not asked if we had called the county. Had we believed there was a si ni cant
release or threatened release (Health & Safety Code Sec. 25507), we would have made the
call ourselves.
Paragraph 7—
Copies of the photos taken on this inspection have not been received.
Thank you for your attention to this matter. The J. R. Simplot Company and the Lathrop facility
are committed to responsible environmental stewardship. We are in contact with the San
Joaquin County Environmental Health Department in regard to future reporting requirements.
Sincerely,
J. R. SIM OT COMPANY
Donna J.
