" J.R.SIMPLOT COMPANY 16777 HOWLAND ROAD P.O.BOX 198 <br /> LATHROP,CALIFORNIA 95330 (209)858-2511 FAX(209)858-2519 <br /> AGRIBUSINESS RLD 7 <br /> E �YIEDD <br /> 2 0 io <br /> May 10, 2010 ENVIr30'V41 1VTh'EALT <br /> PERMITI,�CRtljCS <br /> I <br /> San Joaquin County EHD <br /> Attn: Michelle Henry <br /> 600 East Main St. <br /> Stockton, Ca 95202 <br /> RE: Summary of Violations Response for Hazardous Waste inspection conducted June 29,2009 <br /> Dear Ms. Henry: <br /> The purpose of this letter is to provide a response to the Summary of Violations received on April 14, <br /> 2010 for the inspections conducted on June 29, 2009.As stated in the August 14, 2009 Inspection Follow <br /> Up submitted by the JR Simplot Co. the majority of the items have been corrected as stated below. <br /> Item#5: Illegal treatment of hazardous waste. <br /> This observation was due to neutralizing lab samples in the lab prior to disposal.The JR Simplot Co has <br /> reviewed HSC 25200.3.1 and feels the lab complies with the exemption as outlined in the Code; a <br /> description of how the lab will meet this exemption is attached. <br /> Item#12:Facility not maintained to minimize the release of hazardous waste. <br /> In the Summary of Violations numerous areas of concern were noted; corroded piping,dark oily stains <br /> under equipment in the yard area, dark oily liquid in oil filter left sitting on a vehicle in the yard area and <br /> dark oily staining under equipment staged by the hazardous waste storage area and migrating towards <br /> drain. <br /> All rolling stock/powered equipment in the yard area has been hauled away and recycled as scrap metal. <br /> Prior to removing the equipment, all fluids, filters and batteries were removed and properly disposed. <br /> The impacted soil from these pieces of equipment was disposed of as oily debris. A procedure has been <br /> implemented that will ensure that all retired equipment will have all fluids drained and filters and <br /> batteries removed prior to being moved to the yard where equipment is temporarily stored prior to pick <br /> up by our recycling vendor. <br /> Bringing Earth's Resources to Life <br />
