STOCKTON Aril 20, 2017 <br /> SUMMARY OF VIOLATIONS <br /> (CLASS I,CLASS II,or MINOR-Notice to Comply) <br /> Item# Remarks <br /> 301 CCR 66262.34(d)(2) Facility not maintained to minimize the release of a hazardous waste. <br /> -Dark oily staining was observed on the ground around the used oil drums and buckets stored behind the facility. <br /> -A 5 gallon bucket of paint thinner, paint gun, and other paint waste was observed in the storage building with a <br /> funnel resting inside an open bunghole. According to Mr. Bahr, the bucket has been on site for approximately ten <br /> years, but has never become full because the waste evaporates too fast. <br /> Facilities shall be maintained and operated to minimize the possibility of a fire, explosion, or release of hazardous <br /> waste to air, soil, or surface water which could threaten human health or the environment. Immediately clean oily <br /> stains and stained soil, take all necessary precautions to ensure the paint waste does not evaporate or escape the <br /> storage container, and manage all clean up wastes according to Title 22 hazardous waste regulations. Submit a <br /> statement and supporting documentation explaining how these wastes were managed. <br /> This is a minor violation. <br /> 403 CCR 66262.34(d)(2) Failed to keep hazardous waste containers closed except when adding or removing hazardous <br /> waste. <br /> -Five 5 gallon buckets of used oil were observed in the shop with open pour holes. <br /> -A drain pan of oily water was observed in the shop with no lid; according to Mr. Bahr, the waste is being stored in <br /> the drain pan for disposal because it would not fit in the buckets available. <br /> -A 5 gallon bucket of paint thinner, paint gun, and other paint waste was observed in the storage building with a <br /> funnel resting inside an open bunghole. <br /> All hazardous waste containers shall be closed at all times except when adding or removing waste. Immediately <br /> close these containers and ensure all hazardous waste containers are closed when not adding or removing waste. <br /> This is a repeat violation, Class ll. <br /> 406 CCR 66261.7 Contaminated container not marked with date emptied or managed within one year of being emptied. <br /> A 55 gallon black steel drum which previously held oily water oily water was observed in the yard behind the shop <br /> with no empty labeling. Containers larger than five gallons that previously held a hazardous material shall be marked <br /> with the date they were emptied and managed within one year of being emptied. Immediately mark and manage all <br /> empty containers per this section. <br /> This is a repeat violation, Class ll. <br /> Page 5 of 7 <br />
