CFR 112.3(d) SPCC Plan certification by a Professional Engineer (PE) is missing <br /> • The Ameron International SPCC Plan is currently reviewed and certified by Donald D. Hemphil, a Registered <br /> Environmental Assessor. <br /> • A licensed Professional Engineer must review and certify a Plan for it to be effective to satisfy the <br /> requirements. The PE must attest that he is familiar with the requirements of Code of Federal Regulations <br /> (CFR) 40 Part 112; the PE or his agent has visited and examined the facility; the Plan has been prepared in <br /> accordance with good engineering practice; that procedures for required inspections and testing have been <br /> established; and that the Plan is adequate for the facility. <br /> • Correct by having a California registered licensed PE review and certify the SPCC Plan. Submit a copy of only <br /> the page that contains the statement that the PE has reviewed and is certifying the Ameron International <br /> SPCC Plan to SJC EHD within 30 days (04-30-10). <br /> #8. CFR 112.5(a)) Failed to amend SPCC Plan within 6 months of amendment when there is an <br /> applicable change to the facility <br /> • The SPCC Plan has listed the Designated Emergency Coordinator as Jack Soito. Jack Soito has retired but is <br /> now working as a consultant for the facility. In Section I. General Facility Information on page 1-8. Plan Review <br /> and Amendment, it stated "The Plan must be amended if any of the following conditions occur: .... (3) if the <br /> emergency equipment or coordinator changes." <br /> • Amend the SPCC plan for your facility when there are changes in facility design, construction, operation, or <br /> maintenance that materially affects its potential for a discharge. Amendments made under this section must <br /> be prepared within 6 months, and implemented as soon as possible, but not later than 6 months following <br /> preparation of the amendment. Technical amendments must be certified by a California licensed registered <br /> PE. <br /> • Correct by submitting a copy of the page listing the correct and current person named as the facility's <br /> Designated Emergency Coordinator to SJC EHD within 30 days (04-30-10). <br /> # 10. CFR 112.59(b) Failed to complete a review and evaluation of SPCC Plan at least once every <br /> 5 years. <br /> • The SPCC Plan was last certified by Jack Soito and Donald D. Hemphil when the Plan was first produced in <br /> March 2002. In Section I. General Facility Information on page 1-9 has an entire sheet dedicated for annual <br /> review of the plan. There is a place for the release plan administrator or primary emergency coordinator to <br /> write their signature, a date of review and comments for changes made to the plan. There is no written <br /> documented record of the Plan review since March 2002. On page 1-8, it states that"If there are no emergency <br /> release, .... the plan shall be revised every 3 years." <br /> • A complete review and evaluation of the SPCC Plan must be conducted at minimum 5 years from the date of <br /> the last review was required. As a result of this review and evaluation, you must amend your SPCC Plan within <br /> 6 months of review to include more effective prevention and control technology. Implementation must occur <br /> not later than 6 months following preparation of any amendment. Document your completion of review and <br /> evaluation and sign a statement as whether you will amend the Plan, either at the beginning or end of the Plan <br /> or in a log or an appendix to the Plan. The following words will suffice, 1 have completed review and <br /> evaluation of the SPCC Plan for Ameron International on (date), and will (will not) amend the plan as a result." <br /> • Correct by ensuring facility owner/ operator has documented the review and evaluated at minimum every 5 <br /> years or whatever is stated in your SPCC Plan.
