WASTE DISCHARGE REQUIREMENTS ORDER NO. -12- <br /> KEARNEY-NATIONAL, INC. AND UPRIGHT CONSTRUCTION <br /> FORMER KEARNEY-KPF FACILITY <br /> GROUNDWATER TREATMENT AND DISPOSAL SYSTEM <br /> SAN JOAQUIN COUNTY <br /> the cause of the shutdown and the corrective action taken (or proposed to be taken) to restart <br /> the system. <br /> 6. The Discharger shall notify the Regional Board and the DTSC within 24 hours of any spill of <br /> untreated water. This notification shall include the size and cause of the spill, any immediate <br /> damage to the environment, and the corrective/cleanup actions taken and/or proposed. <br /> 7. Prior to any modifications at the Site that would result in material change in the quality or <br /> quantity of wastes treated or discharged, or any material change in the location of discharge,the <br /> Discharger shall report all pertinent information in writing to the Regional Board for review and <br /> approval. WDRs may be revised prior to implementation of any modifications. <br /> 8. The Discharger shall report promptly to the Regional Board any material change or proposed <br /> change in the character, location, or volume of the discharge. T <br /> 9. Should any evaluation of the treatment process reveal adverse effects on groundwater quality or 1 <br /> its beneficial uses, upon determination by the Executive Officer,the Discharger shall clean up <br /> and abate the effects of discharging any groundwater amendments, including extraction of any <br /> treatment by-products. The Discharger shall provide an alternate water supply for any <br /> municipal, domestic, industrial, or other water use well that is degraded above water quality <br /> objectives as a result of the treatment process. <br /> 10. The Discharger shall maintain records of all monitoring information including all calibration and <br /> maintenance records, copies of all reports required by this Order, and records of all data used to <br /> complete the application for this Order. Records shall be maintained for a minimum of three T <br /> years from the date of the sample, measurement, or report. This period may be extended 1 <br /> during the course of any unresolved litigation regarding this discharge or when requested by the <br /> Executive Officer. <br /> 11. The Discharger shall at all times properly operate and maintain all facilities and systems of <br /> treatment and control (and related appurtenances)that are installed or used by the Discharger <br /> to Achieve compliance with this Order. Proper operation and maintenance also includes <br /> adequate laboratory controls and appropriate quality assurance procedures. This provision <br /> requires the operation of backup or auxiliary facilities or similar systems, which are to be <br /> installed by the Discharger when necessary to achieve compliance with the conditions of this <br /> Order. <br /> 12. Prior to any change in ownership or management of this operation, the Discharger shall �f <br /> transmit a copy of this Order to the succeeding Owner/Operator, and forward a copy of the <br /> transmittal letter and proof of transmittal to the Board. <br /> E <br />
