AGREEMENT FOR GEOLOGICAL AND GROUND WATER TESTING <br /> This agreement is entered into by and between ERNEST <br /> RAYMOND ONETO and GLORIA EVELYN ONETO, Trustees under the <br /> ERNEST AND GLORIA ONETO REVOCABLE LIVING TRUST dated May 23 , <br /> 1991 , of Stockton, San Joaquin County, California, which owns a <br /> part interest in Parcel Number 117-020-19 , hereinafter referred <br /> to as Landowners ; and KEARNEY-KPF, a division of <br /> KEARNEY-NATIONAL, INC. , of 1624 East Alpine Avenue, Stockton, <br /> San Joaquin County, California 95205 , hereinafter referred to <br /> as "Kearney. " <br /> WHEREAS, Kearney is required by the California <br /> Department of Health Services and the California Regional Water <br /> Quality Control Board, hereinafter referred to as "Agencies , " <br /> to assess the geology and the quality of the groundwater in the <br /> vicinity of Kearney' s facilities; and <br /> WHEREAS, Kearney and Agencies have determined that <br /> groundwater monitoring wells should be installed on Landowners ' <br /> property at the locations indicated on the map marked Exhibit <br /> "A" attached hereto ; and <br /> WHEREAS, Landowners desire to grant to Kearney <br /> permission to install , operate and maintain a monitoring well <br /> or wells on a temporary non-permanent basis on the terms , <br /> conditions and covenants hereinafter contained; <br /> NOW THEREFORE, in consideration, covenants , conditions <br /> and promises contained herein, the parties hereto agree as <br /> follows : <br />
