16 . Kearney further agrees that Kearney shall <br /> commence and complete the drilling of any and all wells <br /> permitted to be drilled and installed pursuant to the terms of <br /> this agreement within thirty (30) days after the execution of <br /> this agreement and that Kearney shall further provide <br /> Landowners , within ten ( 10) days after the same become <br /> available to Kearney, with copies of any and all written <br /> reports containing test information and/or test results on the <br /> monitoring wells installed hereunder . <br /> 17 . Should either party commence any legal action or <br /> proceeding against the other based on this agreement, the <br /> prevailing party shall be entitled to an award of reasonable <br /> attorney' s fees and costs . <br /> 18 . Kearney further agrees that any and all disputes <br /> that arise in connection with this agreement or the <br /> installation, construction, operation, destruction or <br /> monitoring of the wells herein provided for shall be resolved <br /> pursuant to the laws of the State of California . <br /> 19 . Kearney understands and acknowledges that the <br /> term "Landowners" as herein used refers to Earnest Raymnd Oneto <br /> and Gloria Evelyn Oneto, Trustees under the Ernest and Gloria <br /> Oneto Revocable Living Trust dated May 23 , 1991 . Kearney <br /> specifically acknowledges that Kearney has knowledge of and is <br /> aware that the Landowners herein are co-owners of the real <br /> property which is the subject of this agreement with Wilma <br /> Garibaldi , a widow, and that Landowners intend to bind only <br /> - 7 - <br />
