AGREEMENT <br /> The parties to this Agreement are UFC CORPORATION, a <br /> California corporation with its principal place of business <br /> located in Stockton, California , owner (s) of 1630 East Alpine <br /> Avenue (hereinafter "the Property" ) in Stockton, California <br /> (hereinafter "Landowner" ) and KEARNEY-KPF, a division of <br /> KEARNEY-NATIONAL, INC. doing business at 1624 E. Alpine Avenue <br /> (hereinafter "Kearney" ) . <br /> WHEREAS, Kearney is required by the California <br /> Department of Health Services and the California Regional Water <br /> Quality Control Board (hereinafter "the agencies" ) to assess <br /> the geology and the quality of the groundwater in the vicinity <br /> of its facility, and <br /> WHEREAS, Kearney and the agencies have determined that <br /> one exploratory borehole should be drilled and one groundwater <br /> monitoring well should be installed on the Prpperty at the <br /> location(s) indicated on the attached map, and <br /> WHEREAS, Landowner desires to cooperate with Kearney <br /> and the agencies while assuring that the installation and <br /> periodic operation of the monitoring well on a temporary, <br /> non-permanent basis protects the use and enjoyment of the <br /> Property to the greatest possible extent , and does not inhibit <br /> or frustrate the ability of the Landowner to negotiate the <br /> timely sale of the Property, <br /> THEREFORE, in consideration of the promises contained <br /> herein, the parties agree as follows : <br />
