• • <br /> Landowner ' s Obligations <br /> Landowner agrees to grant Kearney and its agents <br /> permission to enter upon the Property for the purpose of <br /> drilling the borehole and installing the well in the location <br /> indicated on the attached map . Landowner agrees to exercise <br /> due care not to disturb the well . Landowner further agrees to <br /> grant Kearney and its agents limited access to the well as is <br /> necessary to maintain and sample the well and to , at Landowners <br /> option, destroy the well at the conclusion <br /> of the monitoring program or convey the well to the Landowner . <br /> Kearney ' s Obligations <br /> Kearney agrees to drill the borehole and construct and <br /> maintain the well in a safe manner , and in compliance with <br /> applicable environmental , safety and health laws and <br /> regulations . The well will be constructed and completed in <br /> accordance with the attached plan, and Kearney agrees that the <br /> well will be installed below ground. <br /> Kearney further agrees to correct and remedy any <br /> injury and damage to the Property occurring under this <br /> Agreement by promptly restoring the Property as nearly as <br /> possible to its condition immediately prior to the injury. <br /> Such restoration shall include the removal and safe disposal of <br /> all debris resulting from drilling the borehole and installing <br /> and sampling of the well . <br /> Kearney agrees to provide the Landowner with the <br /> following : <br /> 2 - <br />
