° Groundwater monitoring reports for the Kearney <br /> site on a quarterly basis ; <br /> ° Immediate notification in the event that any <br /> groundwater contamination is initially detected <br /> in the monitoring well on the Property; <br /> ° Immediate notification in the event that Kearney <br /> learns that a spill or release of hazardous <br /> substances or pollutants has occurred on the <br /> Property; and <br /> Assistance in placing the Landowner on the <br /> California Department of Health Services list as <br /> an " interested party" . <br /> Kearney agrees to reasonably limit its access to the Property, <br /> and that of its employees and agents , as shall be mutually <br /> determined by the parties . <br /> Kearney agrees to destroy the well by plugging using <br /> state-approved procedures in a timely fashion after the <br /> required monitoring program has been completed, unless <br /> Landowner opts to assume control over the well at the <br /> completion of the monitoring program. <br /> Kearney agrees to save, indemnify, and hold the <br /> Landowner harmless from and against any and all claims , <br /> demands , suits for loss , injury, damage, or liability of any <br /> kind whatsoever resulting the existence of the well on the <br /> Property or from any negligence or intentional actions in the <br /> installation, construction, operation, or destruction of the <br /> 3 - , <br />
