Manifest numbers 010159120JJK (2013); 010857633JJK,010857635JJK, 011819127JJK,012413640JJK, 013079065JJK,013079066JJK(2014); and 013077522JJK,014644979JJK (2015)were found without a signed off copy from the destination facility. Hazardous waste generators shall retain copies of all manifests signed off by the destination facility on site for three years and have them readily available for review. If the generator did not receive a copy of the manifest with the handwritten signature of the owner or operator of the facility to which the generator's waste was submitted within 35 days of the date the waste was accepted by the initial transporter, the generator shall contact the transporter and/or the owner or operator of the designated facility to determine the status of the waste. If the generator did not receive a copy of the signed off copy of the manifest within 45 days of the date that the waste was accepted by the initial transporter, the generator shall submit an Exception Report that includes a legible copy of the missing manifest, and a cover letter signed by the generator explaining the efforts to locate the hazardous waste and the results of those efforts. Exception reports shall be submitted to: DTSC Report Repository Generator Information Services Section P.O. Box 806 Sacramento, CA 95812-0806 Immediately locate a copy of the missing manifests or prepare and submit an exception report to DTSC. Submit to the EHD a copy of the signed off copy of the manifests or a copy of the exception report submitted to DTSC. This is a repeat violation, Class II. 301 CCR 66265.31 Facility not maintained to minimize the release of a hazardous waste. Oily absorbent was noted in the outdoor hazardous waste storage area next to the product oil tanks, standing liquid was noted on top of the 55-gallon waste antifreeze container, and oily staining was noted on and around the filter crushing equipment located inside the repair pit. Facilities shall be maintained and operated to minimize the possibility of a fire, explosion, or release of hazardous waste to air, soil, or surface water which could threaten human health or the environment. Immediately fix all leaks and staining and manage according to Title 22 hazardous waste regulations. Submit a statement and supporting documentation explaining how this waste was managed. This is a Class II violation. 303 CCR 66265.33 Failed to maintain all communication or alarm systems, spill control, or decontamination equipment. No spill control equipment was available for the waste oil tank stored inside the tank pit. All facility communications or alarm systems, fire protection equipment, spill control equipment, and decontamination equipment, where required, shall be tested and maintained as necessary to assure its proper operation in time of emergency.
