Hazardous waste generators shall retain copies of all manifests signed off by the <br /> destination facility on site for three years and have them readily available for review. If the generator did not receive a <br /> copy of the manifest with the handwritten signature of the owner or operator of the facility to which the generator's <br /> waste was submitted within 35 days of the date the waste was accepted by the initial transporter, the generator shall <br /> contact the transporter and/or the owner or operator of the designated facility to determine the status of the waste. If <br /> the generator did not receive a copy of the signed off copy of the manifest within 45 days of the date that the waste <br /> was accepted by the initial transporter, the generator shall submit an Exception Report that includes a legible copy of <br /> the missing manifest, and a cover letter signed by the generator explaining the efforts to locate the hazardous waste <br /> and the results of those efforts. Exception reports shall be submitted to: <br /> DTSC Report Repository <br /> Generator Information Services Section <br /> P.O. Box 806 <br /> Sacramento, CA 95812-0806 <br /> Immediately locate a copy of the missing manifests or prepare and submit an exception report to DTSC. Submit to <br /> the EHD a copy of the signed off copy of the manifests or a copy of the exception report submitted to DTSC. <br /> This is a repeat violation, Class II. <br /> 301 CCR 66265.31 Facility not maintained to minimize the release of a hazardous waste. <br /> Oily absorbent was noted in the outdoor hazardous waste storage area next to the product oil tanks, standing liquid <br /> was noted on top of the 55-gallon waste antifreeze container, and oily staining was noted on and around the filter <br /> crushing equipment located inside the repair pit. Facilities shall be maintained and operated to minimize the <br /> possibility of a fire, explosion, or release of hazardous waste to air, soil, or surface water which could threaten human <br /> health or the environment. Immediately fix all leaks and staining and manage according to Title 22 hazardous waste <br /> regulations. Submit a statement and supporting documentation explaining how this waste was managed. <br /> This is a Class II violation. <br /> 303 CCR 66265.33 Failed to maintain all communication or alarm systems, spill control, or decontamination equipment. <br /> No spill control equipment was available for the waste oil tank stored inside the tank pit. All facility communications <br /> or alarm systems, fire protection equipment, spill control equipment, and decontamination equipment, where required, <br /> shall be tested and maintained as necessary to assure its proper operation in time of emergency.
