Now ., <br /> The following is an itemized list of hazardous waste violations that have not been addressed <br /> for Dollar General #13593 as of February 20, 2015. <br /> Open violations from October 29, 2013 inspection <br /> Violation #122 and #125-Failed to keep signed copy of manifests from the designated facility <br /> for 3 years. Failed to keep a copy of the consolidated manifest for 3 years. California Code of <br /> Regulations (CCR) section 66262.40(a) and California Health and Safety Code (HSC) section <br /> 25160.2(b)(3) <br /> Copies of hazardous waste disposal records were not found on site. According to Mr. Driscoll, the old <br /> manager left suddenly and no one at the facility knows what he did with any hazardous waste records. <br /> Hazardous waste generators shall retain copies of all manifests signed off by the disposal facility and <br /> all receipts used in a consolidated manifesting procedure on site for three years and have them <br /> readily available for review. Immediately locate a copy of all manifests and receipts for the last three <br /> years, maintain them on site, and submit copies to the EHD by December 6, 2013. <br /> Violation #122 and #705-Failed to keep signed copy of manifests from the designated facility <br /> for 3 years. Failed to send copy of generator manifest to DTSC with an indication that copy of <br /> manifest signed by destination facility was not received after 60 days. CCR 66262.40(a)and <br /> CCR66262.42(c) <br /> Manifest number 000432959PSC (1/2/13) was not found on site. Hazardous waste generators shall <br /> retain copies of all manifests for three years or until a copy signed off by the destination facility is <br /> received. The signed off copy shall be retained and made readily available for review for three years. <br /> If the generator did not receive a copy of the manifest with the handwritten signature of the owner or <br /> operator of the facility to which the generator's waste was submitted within 60 days of the date the <br /> waste was accepted by the initial transporter, the generator shall submit a legible copy of the missing <br /> manifest, with some indication that the generator has not received confirmation of delivery. This <br /> information shall be submitted to: <br /> DTSC Report Repository <br /> Generator Information Services Section <br /> P.O. Box 806 <br /> Sacramento, CA 95812-0806 <br /> Immediately locate a copy of the missing manifest or prepare and submit the required information to <br /> DTSC. By December 6, 2013, submit to the EHD a copy of the signed off copy of the manifest or a <br /> copy of the information submitted to DTSC. <br /> Violation #605-Failed to completely label containers or tanks of hazardous waste. CCR <br /> 66262.34(f) <br /> The "toxic solids" tote contained a label with an illegible accumulation start date. The tote labeled <br /> "alkaline solids" contained a plastic container of liquid; liquid was not listed as a physical property. All <br /> hazardous waste containers shall be marked with the following information: <br /> 1. the words "Hazardous Waste' 4, physical state (liquid, solid) <br /> 2. name and address of generator 5. composition (contents) <br /> 3. hazardous properties (flammable, corrosive, reactive, toxic) 6. accumulation start date <br /> Immediately label these containers property and ensure that all containers are marked with all the <br /> required information. Since it cannot be determined how long the "toxic solids"waste has been on <br /> site, immediately contact a licensed hazardous waste hauler to dispose of this waste under manifest <br /> and submit a copy of the manifest to the EHD by December 6, 2013. <br /> Pagel of 2 <br />
