Violation #701-Stored hazardous waste onsite greater than 180 days. CCR 66262.34(d)
The "alkaline solids" tote was observed with an accumulation start date of January 2, 2013. Facilities
who generate less than 1000 kg of hazardous waste per month and do not exceed 6000 kg of waste
stored on site at any time may store waste on site up to 180 days. Immediately contact a licensed
hazardous waste hauler to dispose of this waste under manifest and submit a copy of the manifest to
the EHD by December 6, 2013.
Violation #703-Failed to comply with Code of Federal Regulations (CFR) 262.34(d), (e) &(f);
CFR 262.34(d)(5)(i) No emergency coordinator; CFR 262.34(d)(5)(ii) No modified contingency
plan
An emergency coordinator and modified contingency plan information is lacking. There must be at
least one emergency coordinator on site or on call to coordinate emergency response measures, and
the following information must be posted by a phone: the name and phone number of the emergency
coordinator; location of fire extinguishers, spill control equipment, and if present, fire alarm; and the
phone number of the fire department, unless the facility has a direct alarm. Immediately appoint an
emergency coordinator and post the required information by a phone. A form is provided that can be
used for this purpose. Submit proof of correction to the EHD by December 6, 2013.
Violation #703-Failed to comply with Code of Federal Regulations (CFR) 262.34(d), (e) & (f)
CFR 262.34(d)(5)(iii) Failed to train all employees on waste handling and emergency
procedures
At the time of inspection, it could not be demonstrated (not necessarily documented) that employees
who handle hazardous waste were properly trained. A StoreNet Learning Management System
training record dated October 29, 2013 indicated that Yesinia Beltran has not had the required
"Environmental Compliance for Sales Associates" training. Mr. Driscoll stated that this training is "only
required once' and is done upon initial hire. The generator must ensure that all employees who
handle hazardous waste are thoroughly familiar with proper waste handling and emergency
procedures. Immediately provide training to all employees who handle hazardous waste and provide
proof of training to the EHD by December 6, 2013.
Violation #812-Failed to keep records of each shipment of universal waste.
Copies of universal waste disposal records were not found on site. A generator of universal waste
(batteries, mercury containing equipment, lamps/bulbs, electronic devices, CRTs, CRT glass, aerosol
cans) shall keep a record of each shipment of universal waste on site for at least three years. The
record may take the form of a log, invoice, manifest, bill of lading, or other shipping document, and
shall include the following:
- Name & address of destination facility
- Quantity & type of universal waste
- Date of departure/shipment
Begin this practice immediately.
