Violation #701-Stored hazardous waste onsite greater than 180 days. CCR 66262.34(d) <br /> The "alkaline solids" tote was observed with an accumulation start date of January 2, 2013. Facilities <br /> who generate less than 1000 kg of hazardous waste per month and do not exceed 6000 kg of waste <br /> stored on site at any time may store waste on site up to 180 days. Immediately contact a licensed <br /> hazardous waste hauler to dispose of this waste under manifest and submit a copy of the manifest to <br /> the EHD by December 6, 2013. <br /> Violation #703-Failed to comply with Code of Federal Regulations (CFR) 262.34(d), (e) &(f); <br /> CFR 262.34(d)(5)(i) No emergency coordinator; CFR 262.34(d)(5)(ii) No modified contingency <br /> plan <br /> An emergency coordinator and modified contingency plan information is lacking. There must be at <br /> least one emergency coordinator on site or on call to coordinate emergency response measures, and <br /> the following information must be posted by a phone: the name and phone number of the emergency <br /> coordinator; location of fire extinguishers, spill control equipment, and if present, fire alarm; and the <br /> phone number of the fire department, unless the facility has a direct alarm. Immediately appoint an <br /> emergency coordinator and post the required information by a phone. A form is provided that can be <br /> used for this purpose. Submit proof of correction to the EHD by December 6, 2013. <br /> Violation #703-Failed to comply with Code of Federal Regulations (CFR) 262.34(d), (e) & (f) <br /> CFR 262.34(d)(5)(iii) Failed to train all employees on waste handling and emergency <br /> procedures <br /> At the time of inspection, it could not be demonstrated (not necessarily documented) that employees <br /> who handle hazardous waste were properly trained. A StoreNet Learning Management System <br /> training record dated October 29, 2013 indicated that Yesinia Beltran has not had the required <br /> "Environmental Compliance for Sales Associates" training. Mr. Driscoll stated that this training is "only <br /> required once' and is done upon initial hire. The generator must ensure that all employees who <br /> handle hazardous waste are thoroughly familiar with proper waste handling and emergency <br /> procedures. Immediately provide training to all employees who handle hazardous waste and provide <br /> proof of training to the EHD by December 6, 2013. <br /> Violation #812-Failed to keep records of each shipment of universal waste. <br /> Copies of universal waste disposal records were not found on site. A generator of universal waste <br /> (batteries, mercury containing equipment, lamps/bulbs, electronic devices, CRTs, CRT glass, aerosol <br /> cans) shall keep a record of each shipment of universal waste on site for at least three years. The <br /> record may take the form of a log, invoice, manifest, bill of lading, or other shipping document, and <br /> shall include the following: <br /> - Name & address of destination facility <br /> - Quantity & type of universal waste <br /> - Date of departure/shipment <br /> Begin this practice immediately. <br /> Page 2 of 2 <br />
