We received your letter <br /> responses dated 22 July 2001 and 18 August 2001 stating that you have been receiving medical attention due to <br /> previous injuries, and have not been able to concentrate on the investigation at your site. We hope you have <br /> recovered from your injuries,and are ready to address the site contamination at this time. <br /> As previously discussed with you,the UST Cleanup Fund(Fund)is available to assist UST owners and operators <br /> with the costs associated with the investigation and remediation of UST releases, and you should re-apply to the <br /> Fund as soon as possible. Please note that investigation work at your site is not stipulated on acceptance by the <br /> Fund, and it is inappropriate to disregard regulatory deadlines while you are applying to the Fund. <br /> However,based on the hardships you have encountered, we will allow you to submit a schedule of work for <br /> investigation at your site. By 5 November 2001, submit a schedule to complete the following: <br /> 1. Complete a minimum of four soil borings around the former UST sites to delineate the extent of <br /> contamination. Collect and analyze soil and groundwater samples for constituents of concern. <br /> 2. Submit a soil and groundwater investigation report. <br /> Failure to comply with these requests may subject you to formal enforcement actions including monetary civil <br /> liability.
