• i <br /> is included in the 12 . 1 ton 1994 Hazardous Waste <br /> Generator total . <br /> Para 2b As stated in your reply of December 13 , 1995, Spreckles <br /> Sugar Company is reporting the combined total of 13 . 85 <br /> ton hazardous waste generated at all of it' s facilities <br /> under one EPA number. This is in violation of Federal <br /> and State laws for generators who produce a hazardous <br /> waste. The generator and disposal facility numbers are <br /> site specific. Each of the three Spreckles facilities <br /> must manifest their hazardous waste under a separate <br /> EPA number. The failure of each site to manifest their <br /> hazardous waste properly involve Illegal Operations <br /> violations which may include the following: <br /> 1 . California Health & Safety Code (CA H & S) <br /> sections 25189 . 5 concerning illegal disposal, <br /> treatment or transportation of hazardous waste. <br /> 2 . CA H & S code section 25189 . 6 concerning illegal <br /> storage, disposal, treatment, handling of a <br /> hazardous waste which causes unreasonable risk or <br /> fire. <br /> 3 . CA H & S code section 25201 illegal storage of <br /> offsite hazardous waste . <br /> 4 .
