Failed to determine if waste is a hazardous waste. <br /> -Metal fine powder is generated from metal saw blade equipment in Bldg C and the metal powder can be <br /> seen on the equipment and some on the tile floor. It is unclear how this waste is being manage, stored <br /> and disposed of. <br /> -Metal scrap pieces are found on the floor around the saw and cutting metal machinery in Bldg J (detail <br /> shop) and D (fabrication shop). In Bldg D, it appears the metal scrap pieces are swept up at the end of <br /> the day into the regular garbage rather than being recycled. In Bldg D, the metal scraps are in the 55 <br /> gallon drum with other garbage debris such as used rubber gloves and plastic. <br /> -Used oil filter along with solid waste (plastic shrink wrap, cardboard, wooden pallets) can be found in <br /> the yard bin designated for only metal scrap recycling. Warehouse has a 55 gallon drum designated for <br /> disposal of used oil filters. <br /> Any person who generates a waste shall determine if the waste is a hazardous waste. <br /> First determine particle size for metal fine powder or hazardous properties if it is eligible for to be <br /> recycled or if it must be managed as hazardous waste. Determine how metal fine powder is to be <br /> managed, make a hazardous waste determination for the waste metal powder, metal scrap pieces, used <br /> oil filter, and manage it according the Title 22 hazardous waste regulations. Particles 100 microns or <br /> smaller, fine powder size, must be handled as hazardous waste if the metal is determined to be a <br /> hazardous waste. Submit a statement and supporting documentation explaining how these above waste <br /> was managed. <br /> Submit to SJC EHD within 30 days (11/25/13): <br /> 1. one copy of the completed "Return to Compliance Certification" form <br /> 2. a written corrective action statement how each of the above violations will be corrected <br /> Notes: <br /> -Paint booth filters & waste paint managed as hazardous waste. <br /> -CERS data is incomplete.
