F7ci <br /> -) r <br /> (b) Notices were duly posted pursuant to Section 8323 of tle` <br /> California Streets and Highways Code in the manner and form re�ir �p ku <br /> conspicuous places along the line of the portion of Navy Drive betty <br /> Burlington Northern and Santa Fe Railroad Crossing and Washington Street in the <br /> City of Stockton, California, which is proposed to be vacated with a reservation of <br /> public utility easement, said notices being posted not more than three hundred feet <br /> (300') apart, along the entire line and that said notices were three (3) in number, <br /> and stated the passage of the resolution of intention hereinabove referred to, and <br /> the date, time, and place of the hearing on the proposed vacation. <br /> 2. All City departments and local utilities were notified and there were no <br /> objections to the proposed abandonment. <br /> 3. This City Council has duly considered all of the evidence and testimony <br /> submitted concerning the vacating of a portion of Navy Drive between the Burlington <br /> Northern and Santa Fe Railroad Crossing and Washington Street in the City of Stockton, <br /> California, and the reserving of a public utility easement and has found from said evidence <br /> that said subject area is unnecessary for present or prospective street rights-of-way, <br /> 4. This City Council hereby orders that a portion of Navy Drive between the <br /> Burlington Northern and Santa Fe Railroad Crossing and Washington Street in the City of <br /> Stockton, California, more particularly described hereinafter, is hereby declared to be <br /> vacated and abandoned for street purposes and that a public easement is hereby <br /> reserved. <br /> 5. The portion of Navy Drive between the Burlington Northern and Santa Fe <br /> Railroad Crossing and Washington Street in the City of Stockton, California,to be vacated <br /> and abandoned and the public utility easement to be reserved by this order is hereby more <br /> particularly described in Exhibits"1,""2," and "Y attached hereto and incorporated herein <br /> by this reference. The area between Washington Street and the Burlington Northern and <br /> Santa Fe railroad Crossing will be reserved as a public utility easement. Fee title to the <br /> proposed abandonment area is vested in the Stockton Port District and the Burlington <br /> Northern and Santa Fe Railroad. <br /> 6. This project is categorically exempt under the State CEQA Guidelines <br /> (Article 19 Section 15301, Class 1). In accordance with Section 65402 of the Government <br /> Code, this activity/project has been determined to conform to the City's General Plan Policy <br /> Document, as amended. <br />
