..i <br /> DISCIPLINARY ACTION <br /> Appropriate conduct, whether employees are on or off duty, is expected at all times while <br /> on Nor-Cal Construction property. Employees should do their best at their assigned job <br /> and follow instructions from their supervisor. Any violation of good conduct or deviation <br /> from Nor-Cal Construction rules and regulations may warrant disciplinary action. This <br /> disciplinary action does not nullify Nor-Cal Construction's right to terminate at-will. The <br /> company may exercise its discretion to use forms of discipline that are less severe than <br /> termination in certain cases. Examples of such less severe forms of discipline include: <br /> 1. With the exception of offenses requiring more stringent action,employees will be <br /> counseled once verbally before receiving a written warning. A note will be put in the <br /> employee's personnel file stating that this has been done; stating the facts of the <br /> offense, and signed by both the person giving the verbal counseling and by the <br /> employee. <br /> 2. In the event of a second problem or violation of any Nor-Cal Construction policy or <br /> rule, a written warning will be issued. <br /> a. The warning will be signed and dated by the employee. If the employee refuses <br /> to sign the warning, another supervisor will immediately be brought in and asked <br /> to sign and witness that the employee has seen,but refused to sign,the warning. <br /> b. The earning will inform the employee of the possible consequences, including <br /> final written warning, suspension and/or termination, should additional violations <br /> or performance problems occur. <br /> c. A written warning need not pertain to the same or similar offense for which the <br /> counseling was given. <br /> 3. If the employee violates any policy of Nor-Cal Construction within a 12 month period <br /> which would be considered a third offense, or fails to improve his level of <br /> performance,termination may result. <br /> a. The warning will be signed and dated by the employee. If the employee refuses <br /> to sign the warning, another supervisor will be immediately brought in and asked <br /> to sign and witness that the employee has seen,but refused to sign,the warning. <br /> b. The warning will inform the employee that termination has resulted due to <br /> violations or performance problems occurring. <br /> c. A final written warning need not pertain to the same or similar offense for which <br /> any prior verbal or written warning was issued. <br /> Nor-Cal Construction will reserve the right to deviate from this policy when it feels that <br /> circumstances warrant such a deviation. <br /> in <br />
