ALLEDGED VIOLATIONS <br /> Health & Safety Code (H&SC) Section 25298: The operator/owner has improperly <br /> abandoned the UST system by not addressing the remote piping to the lube pit. <br /> H&SC Section 25292(d): The operator and owner did not comply with the December <br /> 22, 1998 upgrade compliance date for the UST's. <br /> H&SC Section 25299(a)(5): The operator failed to properly close the UST system, as <br /> required by Section 25298. <br /> H&SC Section 25299(b)(4): The owner of the UST system knowingly failed to take <br /> reasonable and necessary steps to assure compliance with this chapter by the operator of <br /> the UST system. <br /> V. SITE HISTORY <br /> November 13, 1987 <br /> Doug Wilson requested billing be sent for 1986 & 1987 and stated that the UST at this site was not <br /> registered. The owner was given information on tank registration. <br /> May 16, 1988 <br /> Kasey Foley reviewed the file for status and mailed tank owners, Donald & Celia Nathe, <br /> information regarding UST Monitoring Alternative Requirements. <br /> August 18, 1998 <br /> Kasey Foley received precision test results "O.K." Issued 01 permit. <br /> February 12, 1990 <br /> A routine inspection was conducted by Dimetra Papadogiannis, EHS, with tank business operator, <br /> Ray Lopez, that revealed Monitoring Alternative #7 had not been implemented. Dimetra left the <br /> operator Monitoring Alternative #7 information and instructions to precision test (PT) the tank. <br /> Operator complained that the property owner had not given him any monitoring information. <br /> February 26, 1990 <br /> The passing 1990 precision test results were received by the EHD. <br /> January 9, 1991 <br /> Eric Trevena reviewed the file, and the precision test for tank #1. Trevena performed a routine <br /> inspection with operator Ray Lopez. Trevena gave Mr. Lopez a Monitoring Alternative #7 <br /> Inventory Reconciliation chart. Trevena found records for monitoring from February 1990 to the <br /> present. A precision test was performed yesterday, and the results were to be mailed to the EHD <br /> as soon as Ray Lopez received them. <br /> February26, 1991 <br /> Trevena received precision test results for Tank#1, and noted test was tight. <br /> May 24, 1994 <br /> Briggs reviewed the file for compliance and filled out new compliance sheet. <br /> May 25, 1994 <br /> Briggs filed passing precision test results for 1992 & 1993. Briggs also performed a routine site <br /> inspection, and gave a compliance date of June 28, 1994 for performing the 1994 precision test, <br /> and the submittal of Financial Responsibility information. (See Inspection Report) <br /> July 14, 1994 <br /> Today Briggs reinspected the UST with Ray Lopez. Mr. Lopez had monitoring records on site for <br /> the last three (3) years. Mr. Lopez had changed tank gauging farms and was using new forms <br /> 3 <br />
