The EHD/SWRCB UST Upgrade Workshop was held on December 2, 1997 in Stockton and no <br /> one from this facility attended. <br /> On November 9, 1998, EHD sent reminder letters to facilities believed to not be in compliance with <br /> the 1998 UST deadline. It is unknown whether this information was mailed to the facility or the <br /> owner. <br /> On December 1, 1998, Briggs followed up on the compliance information sent by the EHD <br /> concerning the UST 1998 upgrade compliance date, December 22, 1998. Mr. Lopez told Briggs <br /> he could not get Mr. Nathe to cooperate on the UST removal. Briggs called Mr. Nathe, got a <br /> recording, and then it appeared that someone may have hung up the phone. <br /> Doug Wilson called Ray Lopez on December 3, 1998 and told him that he would need to submit a <br /> closure plan and clean the tank prior to December 22, 1998. Mr. Lopez stated he was seeing his <br /> attorney tomorrow and would probably have to pay for the removal himself. <br /> On December 10, 1998, the EHD sent certified letters to notify owners/operators of tanks out of <br /> compliance of the upcoming deadline. This letter was sent to the facility 442 N. Airport Way, <br /> Stockton and the EHD received a receipt for the certified letter. Ray Lopez signed the certified <br /> letter on December 11, 1998. <br /> A Closure Plan was received on December 9, 1998 from Thorpe Oil. On January 22, 1999, Briggs <br /> witnessed the UST removal at 442 North Airport Way in Stockton. During the removal, Briggs saw <br /> underground piping running from the lube pit to the waste oil UST. Briggs inquired if the piping <br /> would be removed that day. The piping removal had not been planned. The sampler did not have <br /> the proper gear to sample and no borings had been done to sample beneath the piping. Briggs <br /> explained to Mr. Lopez that the tank closure was incomplete until the piping had been sampled, <br /> triple rinsed, and removed or filled with a cement slurry under EHD inspection. <br /> Briggs received a portion of the soil sample results on May 28, 1999. Some of the results were <br /> missing. Briggs will follow up with Thorpe Oil to get complete results. As of March 21, 2000, the <br /> missing soil sample results have not been submitted and the additional piping has not been <br /> removed or sampled. <br /> 11.
