Charter Way, Stockton, CA 95206 I. SUMMARY On May 11, 2005, complaint #C00022709 (Attachment 1) was received stating that an underground storage tank (UST)had been removed and left on the property. On May 13, 2005, John Jackson, Senior REHS, obtained permission from both the owner and tenant to investigate the property. During this investigation, Mr. Jackson observed a UST obviously removed from underground that appeared to be the tank in question. Mr. Jackson was told by the tenant that he removed the UST about two months earlier. Photos taken by Mr. Jackson on that date are incorrectly dated May 17, 2005 (Attachment 2). On September 1, 2005, Mr. Jackson sent a certified letter to the tenant, Mr. Alfonso Ocampo (Attachment 3), stating the removal of the UST required a permit from the San Joaquin County Environmental Health Department (EHD). The letter also stated that the permit must be submitted by October 1, 2005. When Mr. Jackson did not receive a removal application for the UST, he phoned the facility on October 26, 2005, and left a message for Mr. Ocampo requesting a call back to discuss the removed UST. Mr. Ocampo called back and informed Mr. Jackson he was merely a tenant and that responsibility belonged to the owner of the property. Mr. Ocampo provided Mr. Jackson the address and phone number for the property owner,Karimullah Bayanzay. On October 27, 2005, Mr. Jackson sent a letter to the Mr. Bayanzay specifying that the removal of the UST required a permit from EHD and the permit was to be taken out immediately (Attachment 4). On November 15, 2005, Mr. Dennis Catanyag contacted Mr. Bayanzay regarding the UST that had been removed without a permit or authorization from EHD.
