LINNE ROAD <br /> TRACY CA 95376 <br /> Dear Mr. Muniz; <br /> I have reviewed the underground storage tank information for your facility and <br /> have determined that the tanks; Tank Record I.D. number 163401 and 163402, <br /> (550 and 350 gallons respectively) , are in violation of the closure <br /> requirements of Article 7 of Title 23, Division 3, Chapter 16 of the <br /> California Code of Regulations. The closure requirements have been detailed <br /> in the following text. <br /> ARTICLE 7: CLOSURE REQUIREMENTS <br /> 2670. GENERAL APPLICABILITY OF ARTICLE <br /> (f) At least 30 calendar days prior to closure, or within a shorter period of <br /> time approved by the local agency, the owner or operator who intends to close <br /> a tank shall submit to the local agency for approval, a proposal for <br /> compliance with 2672, as appropriate. <br /> 2672. PERMANENT CLOSURE REQUIREMENTS <br /> (c) Owners or operators of underground storage tanks subject to permanent <br /> closure where the tanks are approved to be closed in place shall comply with <br /> the applicable provisions of Chapters 6.5 and 6.7 of Division 20 of the Health <br /> and Safety Code and with the following requirements: <br /> (1) All residual liquids, solids, or sludge shall be removed and handled as <br /> hazardous waste or recycled materials in accordance with Chapter 6.5 and 6.7 <br /> of the Health and Safety Code. <br /> (2) If the underground storage tank contained a hazardous material that could <br /> produce a flammable vapors at standard temperature and pressure, it shall be <br /> inerted to levels that shall preclude explosion or to levels as may be <br /> required by the local agency. <br /> (3) All piping associated with the underground storage tank shall be removed <br /> and disposed of unless removal might damage structures or other pipes that are <br /> being used and that are contained in a common trench, in which case the piping <br /> to closed shall be emptied of all contents and capped. <br /> (4) The underground storage tank, except for piping that is closed in <br /> accordance with subdivision (3) , shall be completely filled with an inert <br /> solid . . . . <br /> A Division of San Joaquin County Health Care Services <br />
