(d) The owner or operator of an underground storage tank being closed pursuant <br /> to this section shall demonstrate to the satisfaction of the local agency that <br /> no unauthorized release occurred. This demonstration shall be based on soil <br /> sample analysis and/or water analysis if water is present in the excavation. <br /> Because of this improper closure, this office requires that the underground <br /> storage tanks be removed according Section 2672 (b) of this title. <br /> 2672. PERMANENT CLOSURE REQUIREMENTS <br /> (b) Owners or operators of underground storage tanks subject to permanent <br /> closure shall comply with applicable provisions of Chapter 6.5 of Division 20 <br /> of the Health and Safety Code and with the following requirements: <br /> (1) All residual liquid, solid, or sludge shall be removed and handled as <br /> hazardous waste or recyclable materials in accordance with Chapter 6.5 of the <br /> Health and Safety Code. <br /> (2) If the underground storage tank contained a hazardous substance that <br /> could produce flammable vapors at standard temperature and pressure, it shall <br /> be inerted to levels that shall preclude explosion or to lower levels as <br /> required by the local agency. <br /> (3) When an underground storage tank or any part thereof is disposed of, the <br /> owner or operator shall document to the local agency that proper disposal has <br /> been completed.
