I State of California and confined to Defendant's AUTO DEALERSHIP, PARTS AND SERVICE <br /> 2 1 activities in the County of San Joaquin and elsewhere in the State of California. <br /> 3 3. Defendant, in the course of Defendant's AUTO DEALERSHIP, PARTS AND SERVICE <br /> 4 activities, are pursuant to Health and Safety Code §25100 et seq. hereby permanently enjoined from: <br /> 5 a. Failing to determine if a waste is a hazardous waste, in violation of California Code <br /> 6 of Regulations, Title 22 section 66262.11 CCR; <br /> 7 b. Failing to properly label tank and containers of accumulated hazardous waste, in <br /> 8 violation of California Code of Regulations, Title 22 section 66262.34; <br /> 9 c. Failing to keep containers holding hazardous waste closed during transfer and <br /> 10 storage, except when it is necessary to add or remove hazardous waste, in violation of California <br /> 11 Code of Regulations, Title 22 section 66265.173(a); <br /> 12 d. Failing to submit legible copies of each manifest used to transport hazardous waste <br /> 13 off-site or into California to the department within 30 days of each shipment, in violation of <br /> 14 California Code of Regulations, Title 22 section 66262.23(a)(4); <br /> 15 e. Failing to submit an Exception Report to the department within forty-five(45)days <br /> 16 of the date the waste was accepted by the initial transporter, in violation of California Code of <br /> 17 Regulations, Title 22 section 66262.42(b); <br /> 18 f Failing to properly label oil filters containing gasoline or diesel commingled filters, <br /> 19 in violation of Health and Safety Code section 25250.22(b)(1); <br /> 20 g. Failing to manage universal waste in a way that prevents releases of any universal <br /> 21 waste or component of a universal waste to the environment,in violation of California Code of <br /> 22 Regulations, Title 22 section 66273.13; <br /> 23 h. Disposing or causing disposal of hazardous waste at an unauthorized point,in <br /> 24 violation of Health and Safety Code section 25189.5(a); <br /> 25 i. Failing to maintain and operate facility to minimize the possibility of an unplanned <br /> 26 sudden or non-sudden release of a hazardous waste, in violation of California Code of Regulations, <br /> 27 Title 22 section 66265.31; <br /> 28 <br /> 2 <br />
