I j. Storing hazardous waste without a hazardous waste facilities permit or <br /> 2 authorization, in violation of Health& Safety Code section 25201(a); <br /> 3 k. Failing to determine if the waste had to be treated before land disposal, in violation <br /> 4 of California Code of Regulations,title 22 section 66268.7(a); <br /> 5 1. Allowing universal waste to accumulate for more than one year or failing to <br /> 6 demonstrate the length of time of the accumulation, in violation of California Code of Regulations, <br /> 7 Title 22 section 66273.15; <br /> 8 m. Failing to retain copies of universal waste disposal records for three(3)years, in <br /> 9 violation of California Code of Regulations, title 22 section 66273.19; <br /> 10 n. Failing to prepare and implement a spill prevention control and countermeasure <br /> 11 plan, in violation of Health & Safety Code section 25270.4.5. <br /> 12 4. Defendant, in the course of Defendant's AUTO DEALERSHIP, PARTS AND SERVICE <br /> 13 activities, are pursuant to Business and Professions Code § 17204 hereby permanently enjoined from: <br /> 14 a. Violation of Health and Safety Code §25100 et seq., as described in paragraph <br /> 15 3 - 3n above. <br /> 16 5. Defendant shall pay to plaintiff the sum of TWENTY THOUSAND DOLLARS <br /> 17 ($20,000.00), as and for civil penalties, pursuant to Health and Safety Code §25192 et seq. Said <br /> 18 payment shall be due on the following dates and payable to the following and delivered to the San <br /> 19 Joaquin County Office of the District Attorney, Environmental Prosecutions Unit. <br /> 20 a. $5,000.00, made payable to the SAN JOAQUIN COUNTY ENVIRONMENTAL <br /> 21 HEALTH DEPARTMENT,on or before FEBRUARY 1, 2010; <br /> 22 b. $5,000.00,made payable to the SAN JOAQUIN COUNTY OFFICE OF THE <br /> 23 DISTRICT ATTORNEY, on or before FEBRUARY 1, 2010; and <br /> 24 a $10,000.00, made payable to the CALIFORNIA DEPARTMENT OF TOXIC <br /> 25 SUBSTANCES CONTROL, on or before FEBRUARY 1, 2011. <br /> 26 6. Defendant shall pay to plaintiff the sum of TWENTY-FIVE THOUSAND DOLLARS <br /> 27 ($25,000.00), as and for civil penalties, pursuant to Business and Professions Code §17200 et seq.. <br /> 28 Said payment shall be made navable to the TREASURER OF SAN JOAQUIN COUNTY and <br /> 3 <br />
