1 <br />16 hours credit for time served, toward the first 100 hours of <br />2 <br />community service to be performed. Defendant Art Smith shall <br />3 <br />receive eight (8) hours credit for time served, toward the first <br />4 <br />100 hours of community service. The hours of community service <br />5 <br />duringthe second and third year of probation may be reduced orl <br />6 <br />eliminated if, during the first year of probation, the <br />7 <br />individual defendants have substantially complied with all <br />8 <br />conditions ofrobation and <br />p provided that defendant corporation <br />9 <br />undertakes a program of community service satisfactory to the <br />10 <br />District Attorney, or if she District Attorney is otherwise <br />11 <br />satisfied that there is c_ood cause to reduce or eliminate <br />12 <br />community service during the second and/or third year of <br />13 <br />probation. <br />14 <br />4. The individual defendants shall be placed on informal <br />15 <br />probation for three years. <br />16 <br />5. All the defendants, including the corporation, shall <br />17 <br />'i n'i5 <br />consent to search of the defendant corporation's premises by any <br />18 <br />environmental regulating agency regarding safety, hazardous <br />19 <br />materials and hazardous waste. <br />20 <br />6. Defendant corporation shall plead no contest to Counts <br />21 <br />1 through 6. <br />22 <br />7. The defendant corporation shall pay for two scheduled <br />23 <br />and three unscheduled inspections per year of the defendant <br />24 <br />corporation's premises by the San Joaquin County Department of <br />25 <br />Environmental Health, at the rate of $78.00 per hour, up to a <br />26 <br />maximum of five hours per inspection. <br />27 <br />8.
