California _01 <br />Teieenone::=09) -'68-'--'()0 <br />The three ownersioperators who abandoned this facility have pled no contest to a felony_ <br />charge of hazardous waste disposal. On this site are several 55 gallon drums or <br />deteriorating product/waste, drums of sludge. very large poly tanks (I -'K gallons) of <br />untreated wastewater and various contaminated equipment. Sentencing has been <br />scheduled for April 17. The defendants have been given a plea bargain which will limit <br />their time in Jail to not more than 4 months if by the date of sentencing they have come up <br />with 510,000 (each) to pay for cleanup on the site. <br />Our concern is that this monev be used to abate the immediate hazards on the site, i.e. for <br />a licensed waste hauler to remove the drums and to treat and dispose of the waste water <br />and other equipment onsite. As we all know, the long term site assessment and cleanup <br />will far exceed 330,000. The point of the plea bargain was to provide for remediation the <br />most obvious and easily remedied hazards which are also the most cost efficient to deal <br />with. <br />As I understand, no approval is required to have a licensed hauler remove hazardous <br />materials or waste from the site. However, defendants have agreed to notify the county <br />health department prior to any such removal. One of the "hang-ups" on treating the <br />wastewater on site is the lack of written response from your Department on the question <br />of whether RV can treat onsite pursuant to their old PBR. I have been told that such is <br />possible but the county and defendants understandably prefer that this be confirmed in <br />writing. Can you please provide this as soon as possible? <br />
