w i
to Mr. Smith that it was up to him to resolve his problems
with the City of Stockton. Mr. Smith stated that the City
Manager had told everyone to expedite his request, but somehow
the legal department had his application and was sitting on
it.
Mr. Ito stated that since the facility was not hooked up to
the city sewage system (POTW) the waste stored on the site may
be considered a RCRA or federally regulated waste. Mr. Ito
related that because the facility did not have the hookup then
it would not have the RCRA exemption. Mr. Ito also stated to
Mr. Smith and Tupas that if the waste was considered RCRA,
then over 5, 000 gallons of hazardous waste was in storage at
the facility which would require a permit from CAL-EPA as a
hazardous waste storage facility. Mr. Smith again stated that
his waste problems would be over in three days if he could
discharge. Mr. Smith stated, "You would not usually find the
facility in such a condition at any other time" . Mr. Smith
again indicated that because of his problems with the City, he
was overrun with waste.
Mr. Ito asked Mr. Smith if he knew where the property lines
were. Mr. Smith stated that he was not sure if they were at
the fence line or sidewalk. Mr. Smith was informed that the
batch treatment system, as well as the hazardous waste storage
area, may be less than the required distance from property
lines, i.e. 50 ft.
Mr. Smith was informed that the spent copper anodes found in
the shed were not properly contained in a hazardous waste
container. Mr. Smith was informed that the copper anode waste
must be transported under manifest to a permitted recycler.
Mr. Smith provided a copy of a receipt from the recycler and
stated that the recycler put the anodes in a proper container
to transport them.
Mr. Smith was informed that he would receive a Report of
Violation (ROV) from PHS-EHD in a few weeks outlining the
violations found during this inspection.
The inspection team members at that time left the site.
10
