Mr. Smith stated that the City <br /> Manager had told everyone to expedite his request, but somehow <br /> the legal department had his application and was sitting on <br /> it. <br /> Mr. Ito stated that since the facility was not hooked up to <br /> the city sewage system (POTW) the waste stored on the site may <br /> be considered a RCRA or federally regulated waste. Mr. Ito <br /> related that because the facility did not have the hookup then <br /> it would not have the RCRA exemption. Mr. Ito also stated to <br /> Mr. Smith and Tupas that if the waste was considered RCRA, <br /> then over 5, 000 gallons of hazardous waste was in storage at <br /> the facility which would require a permit from CAL-EPA as a <br /> hazardous waste storage facility. Mr. Smith again stated that <br /> his waste problems would be over in three days if he could <br /> discharge. Mr. Smith stated, "You would not usually find the <br /> facility in such a condition at any other time" . Mr. Smith <br /> again indicated that because of his problems with the City, he <br /> was overrun with waste. <br /> Mr. Ito asked Mr. Smith if he knew where the property lines <br /> were. Mr. Smith stated that he was not sure if they were at <br /> the fence line or sidewalk. Mr. Smith was informed that the <br /> batch treatment system, as well as the hazardous waste storage <br /> area, may be less than the required distance from property <br /> lines, i.e. 50 ft. <br /> Mr. Smith was informed that the spent copper anodes found in <br /> the shed were not properly contained in a hazardous waste <br /> container. Mr. Smith was informed that the copper anode waste <br /> must be transported under manifest to a permitted recycler. <br /> Mr. Smith provided a copy of a receipt from the recycler and <br /> stated that the recycler put the anodes in a proper container <br /> to transport them. <br /> Mr. Smith was informed that he would receive a Report of <br /> Violation (ROV) from PHS-EHD in a few weeks outlining the <br /> violations found during this inspection. <br /> The inspection team members at that time left the site. <br /> 10 <br />
