This is of great concern because, as you are aware, the inspection by your staff turned <br /> up nothing. <br /> I would think we would all agree that, as a citizen and property owner, Mr. Alegre has the <br /> right to be free from unreasonable searches premised on unfounded allegations. In order to <br /> safeguard these rights, it is incumbent on all government officials to take all necessary steps to <br /> ensure that the information they are provided has indicia of reliability and has some basis in fact. <br /> Unfortunately, from the fact of the report, I cannot make such a determination. <br /> Assuming that the Public Health Service was provided with specific information from an <br /> individual who identified him or herself, why was this information not contained in the report? <br /> In my correspondence of November 15, 1994, I "formal[ly] request[ed] any and all <br /> information and/or documents related to Complaint No. C0002856." In response, you provided <br /> me with the two-page Complaint Investigation Report. Given the fact that you did not object to my <br /> request, I will assume that you are in full compliance with my request and that your agency has <br /> absolutely no other information and/or documents related to the Complaint. If my assumption is <br /> incorrect, please let me know as soon as possible so that I may be able to apprise my client of his <br /> legal rights and remedies in this matter. <br /> Your prompt attention to this matter is most appreciated. <br /> Sincerely yours, <br /> EFFREY B.
