properly dispose of the material. The bid from Philips Services has been accepted and it
is expected they will remove the material this week.
#12) Facility not maintained to minimize the release of a hazardous waste.
In the warehouse The broken bags were repackaged. The caustic on the floor was
cleaned and the source repaired. The black plastic drum was not leaking. It will be
repacked when removed by Philips Services.
In the acid rMackg&g area. The low pH liquid on the concrete containment remaining
from repacking operations was removed as discussed in response to #4.
Outside beneath the DE tank A container was placed beneath the area dripping liquid
from the tank to collect the liquid until the material in the tank is removed by Phillips
Services.
Shop in the truck shop area. Training of employees working in the area was conducted
by Jeffrey Kinder, CFR Services. The training included the storage and handling of
liquids used in the truck shop area.
#16) Failed to maintain all communications or alarm systems, spill control, or decon
equipment.
Response gear should no longer be an issue. A policy decision was made by Sierra
Chemical to revise our Emergency Response Policy. The revised policy consists of only
Notification as per the California Hazardous Material Spill/Release Notification
Guidance and support by Technician Level Trained Personnel to the Local Fire
Department. Copies of the Interim Procedure were provided to yourself and Dennis
Fields on July 29, 2005.
#19) Stored hazardous waste onsite for longer than 90 days without a permit or
authorizations.
Manifests were not available on site during the inspection. The only waste that had been
shipped offsite was scrap batteries and used oil associated with the service of forklifts. I
am enclosing invoices reflecting the batteries were returned as a core. The enclosed
service reports show the used oil has been removed by the contractor servicing the
forklifts.
#20)Failed to properly label containers of hazardous waste.
Containers were immediately labeled. Copies of a blank label that were placed on the
containers were provided to Kasey Foley and Dennis Fields on 7/29/2005.
