00 <br /> CLASS II VIOLATIONS: <br /> #10) Failed to determine if a waste is a hazardous waste. This is a repeat violation. <br /> -In the warehouse, an open container of an unknown material was stored with no determination <br /> of its contents. This is a violation of CCR, Title 22, Section 66262.11. <br /> -In the hazardous waste storage area, several drums of material had no waste determination <br /> made. This is a violation of CCR, Title 22, Section 66262.11 <br /> All waste shall have a waste determination performed as soon as the waste is placed in a <br /> container. <br /> #12) Facility not maintained to minimize the release of a hazardous waste. This is a <br /> repeat violation. <br /> -In the warehouse, broken bags of acid were left open on pallets, also an aboveground tank of <br /> caustic was leaking and next to this tank was evidence of concrete deterioration. One black 55 <br /> gallon drum appeared to be compromised with its sides caving in. This facility was not <br /> maintained nor operated to minimize the possibility of a fire, explosion, or any unplanned <br /> sudden or non-sudden release of hazardous waste or hazardous waste constituents to air, soil, <br /> or surface water which could threaten human health or the environment. This is a violation of <br /> CCR, Title 22, Section 66265.31. <br /> In the acid repackaging area, areas of liquid existed on the ground outside. This facility was <br /> not maintained nor operated to minimize the possibility of a fire, explosion, or any unplanned <br /> sudden or non-sudden release of hazardous waste or hazardous waste constituents to air, soil, <br /> or surface water which could threaten human health or the environment. This is a violation of <br /> CCR, Title 22, Section 66265.31. <br /> Outside beneath the DE tank, there were areas of obvious leakage with liquid showing a pH <br /> between 13-14 on the ground. This facility was not maintained nor operated to minimize the <br /> possibility of a fire, explosion, or any unplanned sudden or non-sudden release of hazardous <br /> waste or hazardous waste constituents to air, soil, or surface water which could threaten human <br /> health or the environment. This is a violation of CCR, Title 22, Section 66265.31. <br /> -Shop in the truck shop area, there were areas of obvious spillage within the building. This <br /> facility was not maintained nor operated to minimize the possibility of a fire, explosion, or any <br /> unplanned sudden or non-sudden release of hazardous waste or hazardous waste constituents <br /> to air, soil, or surface water which could threaten human health or the environment. This is a <br /> violation of CCR, Title 22, Section 66265.31 . <br /> This facility shall be maintained to prevent the release of a hazardous waste into the <br /> environment. <br /> Immediately, correct the above violations to prevent the release of <br /> any hazardous waste. <br /> 3 <br />
