The response gear was apparently not maintained as it <br /> was stored in a contaminated state. Also, there was no indication of annual maintenance for <br /> required equipment. Also, eyewashes on site are not being maintained as they are collecting <br /> debris and eye covers are not being used. Maintain all equipment as required by the code <br /> section. <br /> #19) Stored hazardous waste onsite for longer than 90 days without a permit or <br /> authorizations. This is a repeat violation. No hazardous waste has been manifested from <br /> this facility according to Gary Cummings since our last inspection. Obtain a permit to store <br /> hazardous waste or manifest all waste within required time frames. <br /> #20) Failed to properly label containers of hazardous waste. This is a repeat violation. <br /> -In the warehouse many containers were either unlabeled or improperly labeled. This is a <br /> violation of CCR, Title 22, Section 66262.34(f). <br /> Sierra Chemical shall immediately place a proper hazardous waste label on this container that <br /> includes the following: <br /> • The words "Hazardous Waste" <br /> • Accumulation start date <br /> • Composition and physical state <br /> • Hazardous properties <br /> • Name and address of the generator <br /> #21) Failed to keep hazardous waste containers closed except when adding or removing <br /> waste. <br /> -Outside, the DE tank was open. This is a violation of CCR, Title 22, Section 66265.173(a). A <br /> container holding hazardous waste shall always be closed during transfer and storage, except <br /> when it is necessary to add or remove waste. <br /> Immediately, provide a way to close this tank. <br /> #27) Failed to keep signed copy of manifests for 3 years. This is a repeat violation. Gary <br /> Cummings was unable to provide any manifests for the past three years. Records of all <br /> hazardous waste disposal shall be kept for 3 years. This is in violation of CCR 66262.40. <br /> #30) Failed to keep a copy of a consolidated manifest for 3 years. This is a repeat <br /> violation. Gary Cummings was unable to provide any consolidated manifests for the past three <br /> years. Records of all hazardous waste disposal shall be kept for 3 years. This is in violation of <br /> HSC 25160.2. <br /> #31) Failed to keep a copy of manifest or bill of lading for lead acid batteries for 3 years. <br /> No records of lead acid battery disposal were available for reviews.
