Metal fines generated from metal grinding are being mixed with spent absorbent and being disposed <br /> of as non-RCRA hazardous waste oily solids without first determining particle size or hazardous <br /> properties of the metals. Any person who generates a waste shall determine if the waste is a hazardous <br /> waste. Immediately make a hazardous waste determination for the grinding metal and manage it <br /> according the Title 22 hazardous waste regulations. Particles 100 microns or smaller must be handled as <br /> hazardous waste if the metal is determined to be a hazardous waste. Submit a statement and supporting <br /> documentation explaining how this waste was managed by January 19, 2013. <br /> REPEAT VIOLATION <br /> 116. A record of hazardous waste training in the last 12 months was not available for all the employees <br /> on site in the last 12 months; training records were available only for drivers and mechanics/shop <br /> workers. The training program shall be completed by each employee within six months of hire, prior to <br /> unsupervised work, and shall be reviewed annually.
