I with or participating with said defendant with actual or constructive knowledge of this injunction, <br /> 2 only insofar as they are doing business in the State of California and confined to defendant's <br /> 3 trailer towing products manufacturing activities in the County of San Joaquin and elsewhere in <br /> 4 the State of California. <br /> 5 3. No Admission of Liability. Defendant neither admits nor denies the allegations of <br /> 6 the Complaint. <br /> 7 4. Defendant, in the course of defendant's trailer towing products manufacturing <br /> 8 activities, is,pursuant to Health and Safety Code, Chapter 6.5, hereby permanently enjoined <br /> 9 from: <br /> 10 a. Violation of Health and Safety Code§25189.5, disposing or causing the <br /> 11 disposal of hazardous waste at an unauthorized point. <br /> 12 b. Violation of Health and Safety Code §25201(a), storing hazardous waste <br /> 13 on site longer than 90 days without a permit or authorization. <br /> 14 C. Violation of Health and Safety Code§§25270-25270.13, failing to have a <br /> 15 Spill Prevention Control and Countermeasure Plan on site for above-ground petroleum storage <br /> 16 tank(s). <br /> 17 d. Violation of California Code of Regulations, Title 22 §66262.11, failing to <br /> 18 determine if waste is a hazardous waste. <br /> 19 e. Violation of California Code of Regulations,Title 22 §66265 .31, failing to <br /> 20 minimize the release of a hazardous waste. <br /> 21 f. Violation of California Code of Regulations, Title 22 §66265.32(c), failing <br /> 22 to provide spill control equipment, and/or decontamination equipment. <br /> 23 g. Violation of California Code of Regulations, Title 22 §66262.34, failing to <br /> 24 properly label containers of hazardous waste. <br /> 25 h. Violation of California Code of Regulations, Title 22 §66265.173(a), <br /> 26 failing to keep containers of hazardous waste closed except when adding or removing hazardous <br /> 27 waste. <br /> 28 <br /> -2 - <br />
