I be delivered to the San Joaquin County Office of the District Attorney, Environmental <br /> 2 Prosecutions Unit by November 22, 2005. <br /> 3 13. Defendant shall pay to plaintiff the sum of TEN THOUSAND SEVEN <br /> 4 HUNDRED SEVENTY-FIVE DOLLARS ($10,775.00)as partial recovery of the cost of <br /> 5 investigation and suit incurred by the SAN JOAQUIN COUNTY OFFICE OF THE DISTRICT <br /> 6 ATTORNEY. Said payment shall be due and payable to the aforementioned agency, and shall be <br /> 7 delivered to the San Joaquin County Office of the District Attorney, Environmental Prosecutions <br /> 8 Unit by November 22, 2005. <br /> 9 14. Defendant has agreed to fund Environmental Training Programs in the amount of <br /> 10 SEVENTEEN THOUSAND FIVE HUNDRED DOLLARS ($17,500.00),to be used by the <br /> 11 following organizations to assist in the design of and to provide training to California local and <br /> 12 state environmental regulators with an emphasis on multi-media/multijurisdictional enforcement <br /> 13 courses. Said payments shall be made payable to the following organizations and delivered to the <br /> 14 San Joaquin County Office of the District Attorney, Environmental Prosecutions Unit by <br /> 15 November 22, 2005: <br /> 16 a. FIVE THOUSAND DOLLARS ($5,000.00)to California Hazardous <br /> 17 Materials Investigators Association. <br /> 18 b. TWELVE THOUSAND FIVE HUNDRED DOLLARS ($12,500.00) to <br /> 19 California Specialized Training Institute. <br /> 20 15. In further consideration for settlement of this case pursuant to this Final Judgment, <br /> 21 defendant has designated an employee with appropriate training to assist the Plant Engineer in <br /> 22 overseeing all of Valley Industries, Inc.'s environmental,health and safety obligations at the San <br /> 23 Joaquin County Facility. The designated employee has completed(i) Department of <br /> 24 Transportation Awareness training, consistent with the Title 49 of the Code of Federal <br /> 25 Regulations, and (ii) twenty-four hours of Hazardous Materials Technician training. All training <br /> 26 has been performed by a certified third party training contractor. The employee is a full-time <br /> 27 employee reporting directly to corporate management, and shall receive training and continuing <br /> 28 education as appropriate to fulfill the functions of the position.
