TITLE 23 WATER CON'iRC)L BOARD §2672 <br /> (Rpbpr a6,Na 33-&1746) (p. 96.8.15) <br /> (b) Owners of underground storage tanks proposing to remove the under- <br /> ground storage tank shall comply with applicable provisions of Chapter 6.5 of <br /> Division 20 of the Health and SafetyCode,in addition to the following: <br /> (1) All residual liquid,solids, or sludges shall be removed. <br /> (2) If the underground storage tank contained a hazardous substance that <br /> could produce flammable vapors at standard temperature and pressure, then <br /> the underground storage tank,either in part or as a whole,shall be pur ed of <br /> the flammable vapors to levels that would preclude explosion or such lower <br /> levels as may be required by the local agenvy. <br /> (3) When an underground storage tank or any part of an underground stor- <br /> age tank is to be disposed of,the owner must document to the local agency that <br /> proper disposal has been completed. <br /> (4) An owner of an underground storage tank or any part of an underground <br /> storage tank that is destined for a specific reuse shall identify to the local agency <br /> the future underground storage tank owner, operator, location of use, and <br /> nature of use. <br /> (5) An owner of an underground storage tank or any part of an underground <br /> storage tank that is destined for reuse as scrap material shall identify this reuse <br /> to the local agency. <br /> (c) Closure of underground storage tanks in place shall comply with the <br /> applicable rovisions of Chapter 6.5 of Division 20 of the Health and Safety <br /> Code,in addition to all of the following: <br /> (1) All residual liquid, solids,or sludges shall be removed. <br /> (2) All pi mg associated with the underground storage tank shall be <br /> removed and disposed of unless removal might damage structures or other <br /> pipes that are being used and that are contained in a common trench,in which <br /> case the piping to be closed shall be emptied of all contents and capped. <br /> (3) The underground storage tank,except for the pipingthat is closed pursu- <br /> ant to subsection (2) of this subsection,shall be completely filled with an inert <br /> solid, unless the owner intends to use the underground storage tank for the <br /> storage of a nonhazardous substance which is compatible with the previous use <br /> of the underground storage tank. <br /> (4) A notice shall be placed in the deed to theroperty. The notice shall <br /> areal location of the clo <br /> describe the exact vertical and p <br /> sed underground storage <br /> tank, the hazardous substances it contained, and the closure method. <br /> (d) The owner of an underground storage tank being closed pursuant to this <br /> section shall demonstrate to the satisfaction of the local agency that no unau- <br /> thorized release has occurred.This demonstration can be based on the ongoing <br /> I eak detection monitoring, ground water monitoring, or soils sampling per- <br /> formed during or immediately after closure activities. <br /> If feasible,soil samples shall be taken and analyzed according to the follow- <br /> mg: <br /> (1) If the underground storage tank or any portion thereof is removed,then <br /> soil samples from the soils immediately beneath the removed portions shall be <br /> taken. A separate sample shall be taken for every 200 square-feet for under- <br /> ground storage tanks or every 20 lineal-feet of trench for piping,at a minimum. <br /> (2) If the underground storage tank or any portion thereof is not removed, <br /> soils sampling pursuant to Section 2645 of Article 4 of this subchapter shall be <br /> implamented, if feasible. <br /> (3) Soils shall be analyzed for all constituents of the previously stored d- <br /> ous substances and thew breakdown or transformation products.
