The injunctive provisions of this Final Judgment are applicable to Defendants, its <br />subsidiaries and divisions, and any agent, employee, representative and all persons, corporations, <br />or other entities acting by, through, under, or on behalf of Defendants and all persons in concert <br />with or participating with said Defendants with actual or constructive knowledge of this <br />injunction, only insofar as they are doing business in the State of California and confined to <br />Defendants' GROCERY STORE/GASOLINE STATION activities in the County of San Joaquin <br />and elsewhere in the State of California. <br />3. Defendants, in the course of Defendants' GROCERY STORE/GASOLINE STATION <br />activities, are pursuant to Health and Safety Code section 25100 et seq., hereby permanently <br />enjoined from: <br />a. Accepting, treating, storing or disposing of hazardous waste at a facility <br />without holding a hazardous waste facility permit, in violation of Health and Safety Code section <br />25201(a); <br />b. Disposing or causing the disposal of hazardous waste at a facility not permitted <br />or at a point which is not authorized, in violation of Health and Safety Code section 25189.5(a); <br />c. Failing to determine if that waste is a hazardous waste, in violation of <br />~ California Code of Regulations, title 22 section 66262.11; <br />d. Treating, storing, disposing of, transporting or offering to transport hazardous <br />waste without having an Identification Number, in violation of California Code of Regulations, <br />title 22 section 66262.12(a); <br />e. Failing to label or mark containers used for onsite accumulation of hazardous <br />waste, in violation of California Code of Regulations, title 22 section 66262.34(fl; <br />f. Failing to train facility personnel in hazardous waste management procedures <br />relevant to the positions in which they are employed, in violation of California Code of <br />Regulations, title 22 section 66265.16; <br />g. Failing to maintain and operate facility to minimize the possibility of a fire, <br />explosion, or any unplanned sudden ornon-sudden release of hazardous waste, in violation of <br />2 <br />PERMANENT INJUNCTION AND FINAL JUDGMENT PURSUANT TO STIPULATION
