CASE SUMMARY <br /> March Lane 76 was a fuel dispensing facility consisting of three 10,000-gallon <br /> underground storage tanks (UST), that stored 87-octane and 91-octane gasoline and <br /> diesel. Fuel was dispensed through ten dispensers at six dispenser islands. <br /> In early February 2012, the San Joaquin County Environmental Health Department <br /> (EHD) accounting office spoke with the operators by phone when the permit fees for the <br /> year were not paid and found out that the operators closed the business and "gave back" <br /> the station to the bank. <br /> On February 21, 2012, Mr. Garrett Backus, Senior Registered Environmental Health <br /> Specialist (REHS), EHD, drove by the facility and took photos of the closed facility <br /> (Attachment 1). <br /> On March 28, 2012, Mr. Backus sent a Notice to Abate by certified mail to BBCN Bank <br /> and the former operators of the facility, Petros Rai Stations, LLC, for illegal UST <br /> abandonment (Attachment 2). In the notice, Mr. Backus incorrectly stated that he <br /> performed a site visit on February 14, 2012, instead of February 21, 2012. <br /> On June 15, 2012, Mr. Backus received a Notice of Chapter 7 Bankruptcy for Petros Rai <br /> Stations, LLC, filed on May 15, 2012 (Attachment 3). <br /> On June 29, 2012, Mr. Backus performed a routine UST inspection. The facility was <br /> closed and Mr. Backus was unable to verify if the UST system was monitored or not. A <br /> copy of the inspection report was mailed to the property owner, Petros Rai, LLC <br /> (Attachment 4). <br />
