It is <br /> unclear if the facility power is on and the underground storage tank monitoring system is working at the facility. <br /> Inspections of the facility by the EHD on February 14,2012 and March 28,2012 found the store operations closed. <br /> The operating permit fees have not been paid for 2012. <br /> Violations <br /> California Health&Safety Code§25291(b)—The underground tank system shall be designed and constructed with <br /> a monitoring system capable of detecting the entry of the hazardous substance stored in the primary containment <br /> into the secondary containment. <br /> California Health&Safety Code§25298—No person shall abandon an underground tank system or close or <br /> temporarily cease operating an underground tank system,except as provided in this section. <br /> California Health&Safety Code§25404.5—The annual Underground Storage Tank and Hazardous Waste <br /> generator operating fees not paid for 2012. <br /> Corrective Actions <br /> The following actions are required immediately to bring this facility into compliance with Chapter 6.7 of the <br /> California Health&Safety Code and California Code of Regulations(CCR)Title 23: <br /> 1. Restore full time power to the UST monitoring system to restore continuous monitoring. At a minimum, <br /> inspect the UST monitoring panel daily to check for alarms and keep a written log of daily checks and <br /> alarms. Have a certified technician resolve all alarm conditions. Repairs or upgrades to the underground <br /> tank system including the monitoring panel may require an approved permit from the EHD before start of <br /> work. <br /> 2. Pay the 2012 Underground Storage Tank and Hazardous Waste generator operating fees. See the attached <br /> invoice. <br /> 3. Fill out and return the enclosed UST Operating Permit Application with property owner,tank owner and <br /> tank operator information.
