I M. Failing to have evidence of financial responsibility, in violation of <br /> 2 22CCR §2808.1(d). <br /> 3 4. Defendant shall be penalized TEN THOUSAND DOLLARS ($10,000.00), as and <br /> 4 for civil penalties, pursuant to Health & Safety Code §§ 25299 et seq. However, it is stipulated <br /> 5 by all parties that the entire TEN THOUSAND DOLLARS ($10,000.00), in civil penalties shall <br /> 6 be stayed for three years on condition that the following term is met: <br /> 7 a) Defendant will not violate Chapter 6.7 of the Health and Safety Code. <br /> 8 5. The TEN THOUSAND DOLLARS ($10,000.00), described in paragraph 4 above, <br /> 9 shall immediately be due if the San Joaquin County District Attorney files declarations that <br /> 10 defendant violated any of the provisions of either Chapter 6.7 of the Health and Safety Code or <br /> 11 the regulations promulgated pursuant to Chapter 6.7. <br /> 12 6. If all the conditions listed in paragraph 4 above are met then the TEN <br /> 13 THOUSAND DOLLARS ($10,000.00), in stayed penalties shall be permanently lifted three(3) <br /> 14 years from the filing date of this document. <br /> 15 7. Defendant shall additionally pay to plaintiff the sum of FOUR THOUSAND <br /> 16 EIGHT HUNDRED TWENTY-EIGHT DOLLARS ($4,828.00), as partial recovery of the cost of <br /> 17 investigation and suit incurred by the San Joaquin County Environmental Health Department. <br /> 18 Said payment shall be due and payable to the aforementioned agency, and shall be delivered to <br /> 19 the San Joaquin County Office of the District Attorney, Environmental Prosecutions Unit,prior <br /> 20 to the filing of this injunction. <br /> 21 8. Defendant shall additionally pay to plaintiff the sum of TWO THOUSAND <br /> 22 THREE HUNDRED DOLLARS ($2,300.00), as partial recovery of the cost of investigation and <br /> 23 suit incurred by the San Joaquin County Office of the District Attorney. Said payment shall be <br /> 24 due and payable to the aforementioned agency, and shall be delivered to the San Joaquin County <br /> 25 Office of the District Attorney, Environmental Prosecutions Unit, prior to the filing of this <br /> 26 injunction. <br /> 27 <br /> 28 <br /> 3 <br />
