Mr. Shih determined that a permit would not be <br /> required for the repairs. <br /> On July 30,2003,the EHD received a copy of the test results (Attachment 7)performed on <br /> July 21,2003, for piping and sump#3 (diesel). Both secondary components that were tested <br /> passed. <br /> On October 10, 2003,the EHD received a copy of test results(Attachment 8)performed on <br /> October 2,2003 for sumps tested. There was no designation as to which tanks the sumps <br /> belonged. <br /> On March 22,2004,Ms. Dina Abate performed a routine inspection and witnessed a <br /> monitoring certification. It was noted in the inspection report(Attachment 9)that the used <br /> oil sump and piping had not undergone secondary containment testing. Certification of <br /> financial responsibility was also requested for the second consecutive year. Also noted in <br /> the report was a failure of the diesel spill bucket for tightness. <br /> On May 20, 2004,the EHD received the results of the secondary containment testing for the <br /> waste oil system(Attachment 10). The tank, sump, and piping were tested and passed. The <br /> submittal also included other requested documents such as the certification of financial <br /> responsibility and letter from the chief financial officer(dated April 13, 2003),monitoring <br /> and response plan,and maintenance records. <br /> On August 10,2004,Mr. Dennis Catanyag sent a follow-up letter to the City of Lodi <br /> (Attachment 11)requesting a copy of the certification of financial responsibility and letter <br /> from the Chief Financial Officer for the diesel system. Also noted in the letter was the <br /> failed diesel spill bucket. The EHD had not received any update on its status. <br /> On August 13, 2004,Mr. Catanyag received a call from a very upset Mr. Roger Rich,Fleet <br /> Supervisor for the City of Lodi. Mr. Rich could not understand why the letter was sent <br /> because he had submitted the same documents to the EHD four times. Mr. Catanyag <br /> explained to Mr. Rich that the certification of financial responsibility and letter from the <br /> chief financial officer that was submitted was dated April 14,2003. The coverage period <br /> would have ended April 14, 2004. It was also explained to Mr. Rich that the EHD had not <br /> received any information on the status of the diesel spill bucket. <br /> As of August 31,2004,the facility remained out of compliance and still operated,without <br /> an operating permit. Secondary containment testing was completed upon receiving the last <br /> test results on May 20,2004, for the waste oil tank. However,the EHD has not received the <br /> certification of financial responsibility and letter from the Chief Financial Officer for 2004. <br /> A failed diesel spill bucket has not been addressed by the facility. <br /> On October 15,2004,Mr. John Jackson conducted a routine inspection. On this date,the <br /> certification of financial responsibility with a signed date of April 20,2004,was given to <br /> Mr. Jackson. Mr.Jackson noted in the inspection report(Attachment 12)and also notified <br /> Dennis Callahan that cathodic protection must be performed and the facility/tank <br />
