It was discovered the rear door was inoperable after Paul cut off the lock. 15
DTRs were on the ground in the center of the yard and another 20 were in a West Fines
40' trailer. The 20/20 Recycling trailer still held new airplane tires(with 1981 and 1986
stickers still on them).
During the inspection Jerold Brannon questioned Jenni about container tire storage. He
told her that her interpretation of this part of the law was different than his. Jenni told Mr.
Brannon that she was reasonably sure that what the law said was correct, but that at that
moment her job was to complete the inspection.
Toward the end of the inspection,Jerold Brannon was adamantly saying that he was
ready to "go all the way", he said that if he gets this in front of a jury he is confident he'll
win and get the law changed. He told Jenni and Michael that retreadable tires are not
waste tires and Pennsylvania recognized this. Jerold told us that he offered the President
of TRIB a plane ticket to California.
Manifests and CTLs were reviewed. Fermin Alustiza was in the office and was irritated
when Jenni told him that some of the CTLs belonged to and should have been kept at the
Brannon Retread Facility. He claimed that at last inspection, Jenni told him to keep them
at his site. Jenni explained that each location had a unique TPID# and that the truck used
by Advanced Trailer to haul tires was registered under the Brannon Retread facility's
TPID#. Fermin then told his co-worker that he was going to double the price of doing
business so that the customer would fire him and he wouldn't have to deal with tires
anymore. CTLs for the Advanced Trailer facility were in order.
