90 ft <br /> On August 21, 2007, at approximately 12:00 pm, Jenni Frase called Jerold Brannon on <br /> the telephone to arrange a time to meet with him in order to deliver past inspection <br /> reports from July 19, 2007 and June 18, 2007. Mr. Brannon replied that any time after <br /> 2:00 pm would be fine. <br /> At approximately 2:30 pm, Jenni Frase and Michael Kith arrived at the offices of Jerold <br /> Brannon at 3730 N. Wilson Way. Mr. Brannon was in his office with a customer, Mike <br /> Covey, Jr., owner of Covey Auto Express on El Pinal Drive in Stockton. Mr. Covey <br /> excused himself after brief introductions. <br /> Michael Kith and Jenni Frase sat in chairs in front of Mr. Brannon's desk and Mr. <br /> Brannon offered a soda to Ms. Frase and Mr. Kith, which they politely declined. Michael <br /> Kith began the conversation by explaining that the inspection reports were being <br /> delivered more than 30 days late due to the fact that the Department had been waiting for <br /> direction from the District Attorney. Mr. Brannon accepted the explanation and asked if <br /> his facility was in compliance, specifically, "We're okay here, aren't we?"Jenni Frase <br /> then pulled out one of four inspection reports for review with Mr. Brannon. <br /> The first report delivered was for the inspection conducted on July 19, 2007 at the Alpine <br /> Yard located at 1624 E Alpine Avenue. The inspection report documented that Mr. <br /> Brannon no longer rented the site and that site would be inactivated. Jerold Brannon <br /> signed the inspection report, and Jenni Frase returned a yellow copy of the report to Mr. <br /> Brannon. <br /> The second report delivered was for the inspection conducted on July 17, 2007 at the <br /> Advanced Trailer yard located at 2101 E Charter Way. Jenni Frase explained that there <br /> were no violations cited, however the report documented that upon reviewing CTLs at the <br /> time of inspection, a few CTLs were being kept at Advanced Trailer that needed to be <br /> kept at the Fleet/Brannon Tire facility. The reason for this, Jenni explained, was that the <br /> CTLs documented tire transports that had been made in the Advanced Trailer vehicle that <br /> was a registered Waste Tire Hauler under Fleet/Brannon Tire. At this point Mr. Brannon <br /> requested that his employee, Fred Smith,be included in the conversation because Fred <br /> Smith was over-seeing all the paper work at the Brannon facilities. After Mr. Brannon <br /> phoned Mr. Smith, Mr. Brannon asked Jenni Frase and Michael Kith if Fermin Alustiza, <br /> manager of the Advanced Trailer facility, had treated Jenni Frase and Michael Kith better <br /> during this last inspection. Jenni Frase replied that Fermin Alustiza had been fine and <br /> said thank you. <br /> Fred Smith arrived and sat on the sofa to the left side of Mr. Brannon. Mr. Brannon <br /> explained that we were discussing CTLs at the Advanced Trailer facility. Fred Smith said <br /> he had questions regarding CTLs and asked if it would be okay if he went to get a blank <br /> CTL form in order to go further in conversation. Fred Smith returned with some <br /> correspondence from CIWMB and a blank CTL Form. Mr. Smith needed clarification on <br /> when to check the box on each receipt marked"Same As Hauler". Fred Smith said that <br /> when Fleet/Brannon Tire hauler filled out a CTL for the delivery of waste tires to the <br />
