LODI September 14, 2017 <br /> SUMMARY OF VIOLATIONS <br /> (CLASS I,CLASS II,or MINOR-Notice to Comply) <br /> Item # Remarks <br /> 109 CCR 66262.23(a)(4) Failed to send generator manifest copies to DTSC within 30 days. <br /> Generator copies of manifest number 015911731JJK (10/28/16)was not sent to DTSC within 30 days of shipment <br /> of hazardous waste. The generator manifest copy shall be submitted to DTSC for every shipment on a manifest <br /> when California is either the generator state or the destination or consignment state. The generator manifest copy <br /> shall be mailed to: <br /> DTSC Generator Manifests <br /> P.O. Box 400 <br /> Sacramento, CA 95812-0400 <br /> Immediately mail a copy of the manifest listed and ensure that copies of all generator manifests are sent to DTSC <br /> within 30 days of shipping hazardous waste. <br /> This is a Class II violation. <br /> 110 CCR 66262.40(a) Failed to keep signed copy of manifests from the designated facility for three years. <br /> Copies of uniform manifests for the disposal of hazardous waste solids were not found on site. No waste <br /> absorbents were observed on site. The facility has an empty drum labeled for hazardous waste solids. Employees <br /> stated that they use kitty litter to clean up spills approximately once a month and then place the waste in the <br /> hazardous waste storage area for disposal. No waste absorbent was observed on site and no disposal records <br /> were available for disposal of waste solids. Hazardous waste generators shall retain copies of all manifests signed <br /> off by the disposal facility and all receipts used in a consolidated manifesting procedure on site for three years and <br /> have them readily available for review. Immediately locate a copy of all missing manifests and receipts for the last <br /> three years, maintain them on site, and submit copies to the EHD. <br /> This is a repeat violation, Class II. <br /> 117 HSC 25185(c)(3) Failed to submit a written response within 30 days of receiving an inspection report. <br /> An inspection was last done on 9/22/16 and an inspection report was issued identifying information to be submitted <br /> to bring this site into compliance. This information was required to be submitted by 10/22/16. This information has <br /> not been received resulting in a non-compliant status for this facility. The outstanding violations include: <br /> -Failing to completely label containers or portable tanks of hazardous waste <br /> -Stored hazardous waste onsite greater than 180 days <br /> An operator that receives an inspection report shall have 30 days to submit a written response that includes a <br /> statement documenting corrective actions taken or proposing corrective actions which will be taken. Ensure that a <br /> written response documenting corrective actions taken or proposed is submitted within 30 days of receiving an <br /> inspection report. <br /> This is a Class II violation. <br /> Page 4 of 6 <br />
