SAN _J O A Q U I N Environmental Health Department
COUNTY
Underground Storage Tank Program Inspection Report
Facility Name: Facility Address: Date:
GAS DEPOT#2 1330 E YOSEMITE AVE, MANTECA December 28, 2018
SUMMARY OF VIOLATIONS
(CLASS I,CLASS II,or MINOR-Notice to Comply)
Item# Remarks
321 CCR 2635(b)(2) Overfill prevention was overridden.
The mechanical overfill prevention device on the Diesel UST is currently set to be at 99%capacity and not at 95%
or below as required by regulation. Furthermore, the service technician on site stated that the 91 product and 87
product tanks did not have mechanical means of overfill nor was there an audible and visual alarm to alert the fuel
delivery truck driver when the tank has reach above 90%capacity.The service technician on site stated that all
three tanks failed overfill prevention equipment inspection. All underground storage tanks shall be equipped with an
overfill prevention system that does not allow for manual override and meets one of the following requirements:
1. Alert the transfer operator when the tank is 90 percent full by restricting the flow into the tank or triggering an
audible and visual alarm; or
2. Restrict delivery of flow to the tank at least 30 minutes before the tank overfills, provided the restriction occurs
when the tank is filled to no more than 95 percent of capacity;and activate an audible alarm at least five minutes
before the tank overfills; or
3. Provide positive shut-off of flow to the tank when the tank is filled to no more than 95 percent of capacity; or,
4. Provide positive shut-off of flow to the tank so that none of the fittings located on the top of the tank are
exposed to product due to overfilling.
Immediately contact a properly licensed, trained, and certified contractor to install an approved overfill prevention
system. Replacement of a mechanical flapper valve requires a permit and inspection by the EHD. If an external
audio/visual alarm is replaced, provide a copy of the service receipt to the EHD. If an approved overfill prevention
system can't be installed immediately, there is a possibility that the the 87 product, 91 product and Diesel product
UST system may be red tagged to prevent fuel inputs.
This is a Class I violation.
Overall Inspection Comments:
Complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement
documenting the corrective actions that have been or will be taken for each violation, and any supporting
paperwork, by January 27th, 2019.
Document reviewed: Monitoring system certification test results from 2016, 2017, Secondary containment 2018,
employee training, response plan, maintenance records, monitoring plan, financial responsibility documents and
designated operator monthly inspection reports from December 2018-November 2018.
Documents provided: Return to compliance certification.
Starting September 1, 2018, all in-office CERS help will be provided at EHD hourly rate ($152). To schedule an
appointment, please call (209) 468-3420.
NOTE: The inspector was not able to witness completion of the spill container test results for the 87 product, 91
product and diesel product tanks, EHD will await for test results to review and determine if further violations will
be added.
FA0012355 PR0515864 SC001 12/28/2018
EHD 23-01 Rev.09/28/2018 Page 7 of 8 Underground Storage Tank Program OIR
1868 E.
